Responsibility - Tmobile or Samsung ?

My Tmobile (on contract) phone - a Samsung Note N7000 REFUSES to accept a Jelly Bean update
I have tried via KIES and via WiFi - it downloads the file, but won't install it !!
I have asked Tmobile for help - they told me to try Samsung
Samsung deny responsibility - informing me that it is down to the reseller (ie Tmobile)
I am stuck at this point - I am assuming that Samsung are correct but can't get any further help from TM
Any advice ?
The update was released by TM about 2 months ago and I don't want to risk any third party downloads/installation methods !!

    It has nothing really to do with T-Mobile as they don't warrant or guarantee firmware updates as part of the contract.

    It is more to do with Samsung, as they control how KIES works, but again, access to firmware updates is an ancillary issue, while they should help from a CS perspective, I don't think they can be forced to comply.

    My only other thought would be to push the issue from a faulty handset perspective. Samsung issued the firmware update, your handset refuses to load it, therefore the handset must be faulty.

    Have you considered asking Samsung to load the firmware for you by sending the phone in to a Samsung service centre?

    Update is a gift not a right from Samsung and the network .


    Update path is Samsung update and send the updates to the network . Network then decides to update or not .

    Handset is not faulty its Kies usually but that can be your PC and ot USB ports
    .
    WiFI OTA updates fail due to bad connection or a rooted or customized firmware .

    As you don't want to use other methods no options i can see.

    What about KIES itself being "faulty" ?
    My PC's are all fine as are USB ports - I have tried on 3 PC's with the same result !!
    Surely - if a company supplies software (be it at cost or free) - it should be up to the job for which it is designed - and KIES is NOT !!
    Just google KIES PROBLEMS and see many pages you get.....

    You didn't buy Kies - so is irrelevant. A firmware update may be desireable but if you brick it in the process you have no comeback against anyone. Like windows phone users - they are stuck with what they bought, and no upgrade availability is the name of the game.

    Only Apple seem to make this seamless and achievable - albeit at a price - until your updates stop due to hardware shortcomings.

    I know Apple get plenty of stick but I do like the way they support their devices long term. The iPhone 4 will run the new iOS 7 yet how many android manufacturers will be releasing updates for their 2010 handsets this year?

    Kies is a terrible, terrible piece of software. You'll have more success using Odin to update the phone.

    Personally, if I had the chance, I would have stuck with ICS on my Note. The implementation of JB seems to be appalling - there are many resports from other people the same as me - it is so slow and laggy as to be massively frustrating.
    Oh, and agree with the above, Kies is simply !!!!!. I got the upgrade OTA (over the air) on my mobile itself (unlocked mobile, but bought on a t-mobile contract).

    JB on my Note 10.1 not a problem at all .
    But it was a clean install not an update over ICS .


    If Kies is faulty download the latest or another version .

    As Kies is Samsung software you can either take them to court or ask a Samsung service center to upgrade as Kies fails .

    Essence is both the update and Kies are free not an entitlement that came with the phone .


    The common Kies problems are not using original cable , not using a motherboard USB port . Drivers / Kies not installed correctly .

    Kies has Tools Troubleshoot ,and other help stuff .


    I no of no way around the Kies OTA update problem bar using firmwares flashed via Odin. From http://forum.xda-developers.com/ and similar .
