Advice on Blackberry Repair please

Hi, Im hoping someone can give me a bit of advice about this as I really don't know what im going to do.
First of, i put my daughter on a monthly contract back in September and got a BB 9320, now on 14th june i booked it in with carphone warehouse for repair, the details logged were .. trackpad and some buttons work intermittently. She could use the phone, but the trackpad would freeze occasionaly. Additional details were.. some keys do not respond. Anyway, we were told it was still under warranty as they have 2 years on them, we got the phone back 25th june. The repair was deemed repairable at £169.99 as my husband had put a new housing on the phone and therefore voided the warranty. Anyway, I took the phone home, charged the battery, and to my horror, the keypad wouldnt work at all!! And also part of the housing (red plastic) was sticking out of the ear piece. We took the phone back and complained, carphone warehouse phoned BB and told them the situation, the phone was then sent back to BB for repair free of charge for the damage they had caused. Now, I have a notification that BB could not fix the phone and it was being returned to CW. The phone was fully functional before it went for repair apart from the trackpad freezing occasionaly... What do i do if they still haven't fixed the phone and the kepad doesn't work?? Do i kick up a fuss and demand a replacement or do i just accept that my daughter now has a phone she can no longer use?
