Unfair charges with Natwest claim

Hi there peeps,
Sent of request for refund to Natwest.
Total was claiming was £2800 from the past 3-4 years.
Was getting hit with overdraft fees of £100 + each month, returned DD fees sometimes for 2-3 bounced DD's.
Have been seriously struggling financley for past few years and have made this clear to them with a well thought out and scripted letter.
Have made it clear that I have a negative surplus and my account shows payments to and from multiple wage days advance companies, shows payments to creditors including mortgage and shows my income. So they can verify my situation by simply looking at my account.
I have now got the commitment and energy to get back on my feet and have been fighting with depression after some personal reasons.
I have recieved a reponse now as follows and have cut out most of the standard spiel and BS:
"My understanding of your complaint is that you are unhappy with the charges that have debited your account as you feel the charges are unfair and excessive.
Im sorry I am unable to agree with your complaint relating to the charges that have been applied to your account.
I understand that you are unhappy with the level and amount of these charges, however, they have been applied correctly and are in line with the Terms and Conditionsof your account. Additionally the Supreme Court's ruling confirms that the charges applied are considered part of the prince by the customer in exchange for the package of services which made up a current account.
Although the fees are justified, as part of helpful banking, I have refunded £270 for Unarranged Overdraft Fees and further waived a £6 unarranged Overdraft Fee which was cheduled to debit on 26 July 2013 as a gesture of good will."
"I hope I have been able to explain the position for you. If you are unhappy with my decision you have the right to the Financial Ombudsman (FOS)"

So I have recieved this refund last week but have been chagred again £108 for urranged overdraft fee.

Any help on how to proceed from here or is it best to call its quit. I dont want to go on an all out attack against them, at the end of the day I accept this is all my own doing and should have managed my finances better.
Although it seems I have a hidden overdraft of maybe upto £100 intop of my currect DD which the bank allows me to go into but then results in charges n charges which hurt!

I now have realistic arrangments with most of my creditors and am finally getting on top of my finances.
I am thinking of phoning them or any advise on what comments to make ant to euther write or phone or escelate to the Ombudsman?

    The Banks won the case against "unfair" bank charges and the "goodwill" payment is all you'll get.
    You should probably now be forgetting about the Ombudsman with regard this and going to the "Debt Free Wannabe" board for help and advice.

    The FOS wont take on complaints about "unfair" bank charges since the banks won the court case. So, what would you be looking to achieve by going to the FOS?

    To clarify, the bank are obligated to inform you of your right to escalate any complaint to the FOS should you not agree with their resolution. This is why they have done so.

    However, as mentioned by both posters above, the FOS cannot decide on the fairness or otherwise of charges, especially in light of the Supreme Court ruling on this matter. Only a court can decide whether or not the fees are fair or not.

    The MSE article has a link to how to make such a legal challenge, but read the warning first about no one reporting any success in the 3 years it has been published.

    I too think your time & effort would be better spent posting on the Debt Free Wannabe board ... and that is FREE! :)

    Why don't you arrange a suitable overdraft with the bank if you know you are going to be overdrawn?

    Have tried to before but been declined :( There reason was I needed to stop going over my overdraft limit for at least 6 months before they would consider increasing.
    Going against advise given on this post, I have sent a reply to there response now asking for at least 80% of charges to be refunded. Will post when I get a reply, no harm in asking :)
    Have now sent letters claiming unfair charges with Vanquis and Welcome Finance and am expecting a reply back shortly.
