Sorry for the rambling post, I typed it in haste as I was trying to leave, will try to edit it in a minute.
We paid by debit card which i'm kicking myself for.
Hindsight is a wonderful thing. I am already beating myself up enough about the whole thing without anyone being sarcastic. We didn't stay to look at the car once it returned as we were genuinely concerned for our safety but the men did say it had been mot'd but that it still needed smoke stop putting in to clear the engine so I can only presume that they hadn't sorted the smoking issue.
We had already queried how it would pass an mot with only one windscreen wiper and also whether it would pass the emissions test, we were fobbed off on both points.0 -

If it was advertised as having an MOT then why should you be paying for it? (which is what you have effectively done by only getting £150 back..)

A smokey diesel could pass, maybe the dpf had been removed.0

I was going to tell you that they could legitimately deduct their costs from the deposit until I read the bit about stop smoke and missing wiper. Was the salesman called Coco with a big nose and shoes and did the doors fall off when he blew his horn?0

The garage don't sound as bad as you make out. They agreed to check it over and sort out the smoking, then put a full years Mot on it. Then before you even saw the car you backed out of the deal. So unless they failed in their promise to sort the smoking out, it is you breaching the deal so £150 back sounds reasonable0

That's my thinking too. If I was the seller, paid a garage to look at it and MOT it all in a space of two hours, I would not be pleased if they messed me about.0 -

They didn't though did they?We got back to the garage and they said the car would be another 20 minutes as while it was away they realised it didn't have an MOT but had been advertised as having one so they were getting it done. The salesman kept apologising for the delay, kept saying we could have our money back but then kept saying it wouldn't be long, this went on for an hour. By this point alarm bells were ringing so we went to ask for our deposit back, the salesman got quite nasty, argumentative and threatening. He said he couldn't put the money back on my card so would have to do a bank transfer. In the middle of this his manager returned with the car. We explained that we didn't feel comfortable with the transaction and would like our deposit back. Things got quite heated and we were concerned about our safety and that of our current car.
The OP was more than reasonable in giving them the chance to fix the car. The dealer, rather than call the OP to say "hang on, there has been an issue, don't come as we need to MOT the car" keeps the OP and family standing around for an hour which would have anyone wondering what is goign on.
All the time the sales chap is saying they can have their money back but when they try to take up his offer his attitude leaves them concerned for their safety.
I fail to see what part of that is the OPs fault?
Do you expect to be abused by sales staff?
The dealer made the mistake and compounded the issue with poor service. If that's what they are like when they are trying to get you to buy a car then what will they be like if you ever needed to go back?
OP did the right thing in this case.What if there was no such thing as a rhetorical question?0
