Most SL's only apply to court a last resort if they cannot come to an agreement with the tenant or the tenant makes an agreement to clear and then doesn't. At least that's how it works with us. A few questions:

    How much are the arrears?
How long has your account been in arrears?
When did you make the agreement to pay £20pcm off the arrears?
Have you missed any payments since the agreement was made?
Good Qs which will get us from 25% to about 50%.

If OP wants proper advice, we need 100% of the history and facts.

I'm guessing, and I may be completely wrong, that perhaps the arrears have been around for some time and the only way the SL could get the money paid was to apply to the court for an SPO to force the tenant to pay. It is unlikely that an eviction will be granted for 3 weeks rent arrears, in fact I would go as far as to say almost unheard of.

If we had more info, as GM says, we can give better advice.

So you started paying £20pcm off the arrears six months ago and now they've decided to put you into court? Is £320 the arrear now or the original arrear? Also why is the local councillor involved? Sorry, I'm a bit confused.

Locqp councillors involved because they wouldn't negotiate with me
And yep now thats my problem offerex income and expenditure form repeatedly. Paying on 30th of each month via bank transfer payment had been sent on 28th which is when the first letter was hand delivered.

Have you been in arrears before then and byhow much? And what action was taken last time? Sorry for all the questions but am puzzled as to why court action is being taken for what is a small arrear.

Was off ill last year was in arrears whilst waiting for redundancy payout cleared most of arrears with that and have been paying 20 off per.month since they wanted more which is when I offered the I& E first told no they were aggressive so I contacted LC he told me not to worry as under 8 weeks arrears is now doen to 3 then this at least I know it shouldn't have been sent to court and the court will likely push it out which helps.
    Thank you
