No, their mum is entitled to child tax credits/child benefit because she is the main carer
Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

My mate who is now over 60 was evicted 2 years ago so I took him in. But I have been on esa for 13 weeks and may now have to go on jsa. I cannot get ctax benefit as I am being honest and that he is doing a few jobs like a paper round, collecting glasses at a club an earning around £120 a week. He gives me around £40 per week. But someone from the advice centre said that I should think of myself here and more or less kick him out. I would find that very hard to do and what would happen to him. He is 61. Would he be better off elsewhere due to his age. What would you do if you were in my situation.
Sorry if it is not clear. very stressed atm.

    Thanks all.
Why do you think you need to change from ESA to JSA? It has only been 13 weeks. I would leave it until you have been invited to complete form EAS50 which needs to be returned to ATOS who decide if you need to attend what is called the Work capability assessment. You obviously have some problem as you would not be able to get ESA unless a GP signs you off from working for some reason. This is a list of the ESA descriptors - read them and see which ones may apply. http://pseudo-living.blogspot.co.uk/2012/03/esa-descriptors-and-points.html ignore the JSA angle for the moment. Concentrate on the council tax support and any help with rent. That is more important at present.
  • Horseunderwater. I phoned esa today and decided to appeal. they said they would send me out a form today and the quicker I send it back they will continue to pay me from the 18th while the appeal is being heard. I looked at the descriptor and there is one thing that stands out and that is I get angry very quickly and that could be down to severe depression atm. thanks for your help and everybody's else.
  • Hi all. I sent an appeal form off on the 3rd July with the sae inside but it was to an office in Basildon. I phoned Glasgow to query this and they said that that was the office dealing with your claim. Anyway it wasnt. So last Friday I wrote out another appeal on a plain piece of paper and the local jobcentre faxed it off for me. I still have not heard anything yet. Should I be concerned yet. Its almost a calender month since this was stopped so I was wondering if I should try and get a hardship loan or whatever they are called now.
    Just wondering.
    Thanks
  • Still no money in and I have no credit on phone to call them. What can I do now please.

Do you have or need medical evidence for this?

Can you go to the Jobcentre and talk to someone?

  • Hello HBS and thanks for your reply. I actually got my esa backdated from 18th of June yesterday which was a great relief. I had a one to one on the phone with a fresh start advisor and I am waiting to see what they will do next.

    Thanks
