Abusive Seller

Hi folks - can I run something by you?
I have 100% feedback from 81 transations, mostly as a buyer.
I recently bought 2 x DVDs, sellar had transferred them from VHS, Scottish plays which I know well, as I have them on VHS already. 1 copy is for me, 1 for a present.
Gripe 1
The ad. included artwork + a cover but the actual item was a DVD in a plastic wallet. (x 2)
Gripe 2
Seeing as I know all of the plays very well, a quick glance proved that a bit was missing, I saw the tape jumping plus I have the missing bit in my VHS copy.
I asked for a refund. Sellar offered 2 new ones. I said that his original was flawed so what good would that do? Plus I queried the absence of the artwork covers, which he dismissed.
He has now resorted to abuse.
Advice please?
I could name him and shame him on here.
I could also hijack his other auctions, under my new user, so as not to ruin my existing user with 81 +ve feedbacks.
In the meantime, i'll take a step back and listen to advice.

You have his email address in the payment somewhere, just goto some scrupulous websites and sign him upto.........................yes i would like to receive naked men/women every day in my mailbox!, if you have his phone number and its a mobile do the same!

Ive got a couple of Ebayers that have conned me and would love to hurt their pockets but don't know how. I think sometimes you have to just learn by your mistakes and move on.
As for complaining to Ebay, its a waste of time. They don't care. Believe me, Ive tried!0 -
has he offered to copy them again from vhs or just to send you more of the same?
if he said there was a cover and there was none then he is mis-selling the item and should be reported to ebay.

He is not allowed to sell copies of videos on DVD. I know because I was selling copies of old TV programmes which I had recorded in the 80s such as TOTP 25th Anniversary and Swap Shop amongst others. My account was suspended and I had to fax in a form which I signed saying I would not sell any more items which did not have the copyright permission of the third party (i.e. BBC etc).
The best thing to do is report him for selling copies as he will then get a warning from eBay which if repeated will result in a suspension. Then just see if he posts more of the same items after a few weeks and report him again.....0 -
Log an item is significantly not as described dispute with Ebay. they will probably tell him to refund your money. Too many of those and he gets booted.0

Do you get booted if you have too many chargebacks ? I didnt think the seller got any warnings or strikes for this .0

Will they tell him to refund the money? Do you know anyone this has happened to? Im in dispute on Ebay about something someone sold me at the moment and I don't hold out much hope that Ebay will get my money back. For one thing they said they will need a copy of the cheque I sent him and, of course, I didn't take a copy!0 -

With cheque payment there is virtually nothing you can do except file a non performing seller complaint with ebay. If you paid by paypal you can also try the option of 'item not as described' complaint with them which has the advantage of putting a hold on his paypal account which will severely limit his trading activites for a while.
You might not get your money back even with paypal, but they do log the amount of chargebacks that go through seller accounts. It's also been my experience that sellers are often intimidated by an approach from paypal limiting their accounts and will often refund rather than dispute the case further.
