I didn't post, I emailed directly to them and I definitely wasn't outside the 28 days. I'll reply now.
Edit - they've already replied with an ammended letter. They'll be considering my appeal on or just after 1/11/13.

I've recieved an evidence pack which basically looks like them trying to counter my claims, using the first email I sent as a justification for refusing a POPLA code. Obviously the email POPLA recieved was far more in depth.
An interesting note is that theyve provided a copy of the sign used and it clearly states (on the one in the email I recieved at least) that the full amount of the parking charge will be donated to the Tesco charity of the year. Is there any way to ensure 100% that this happens? Because I have serious doubts.0 -
No, it will be worded by Tesco and say 'all profits are donated' and that is Tesco's own profits which is about 5% of each parking charge. Not the PPC's ill-gotten gains. Misleading, isn't it?

And as the PCN is generating profit (even at just 5%) it proves there are no losses. I presume, OP, genuine pre-estimate of losses was writ-large in your POPLA appeal?Please note, we are not a legal advice forum. Sorry to drag up such an old thread, but I finally heard back from POPLA a few weeks back (apparently my appeal got lost in the pile).
I can confirm that POPLA granted my appeal on the grounds that I asked Highview to prove they had a contract with the landowner to issue penalties and because they refused to do this then the ticket wasn't enforcable. So for anyone else considering an appeal, here's a good angle to go for.0 -
