will i be able to claim anything?

hi, I was wondering if any one could help, I moved from wales to live with my partner in Hereford two years ago . I rented out my house, which I own outright, now my partner doesn't want the relationship anymore, im in bits and don't know what to do, since coming here I have had a job which I like, but will have to quit it to move back to my house. will I be able to claim any benefits if I give up my job? I have a tenant in my house at the moment, they have only been in there for 6 weeks but I will have to give them 2 months notice to leave. I feel bad about this but have no other choice. thanks in advance for any help.

  • You will be able to claim £0.

    You own your own house, that's a pretty big asset. You could do a flat share for a few weeks until you can move back into your fully owned property.

    Assuming your house is in England or Wales and your tenant has an assured shorthold tenancy.

    If your tenant has only been there for 6 weeks you won't be able to end their tenancy until the end of their fixed term unless their are grounds to do so such as rent arrears. If there was no fixed term they have protection from eviction for 6 months. Even after the service of valid notice they still don't have to leave and you would then need to obtain a court order and bailiff warrant to get them out.

    Please listen to this, otherwise you will be trying to force an illegal eviction.

    Can you rent another property and stick it out in your job until you can move home?

    oh dear, that's worse than I thought then, I can stay with a friend and keep my job for two months but don't know what to do then. when I eventually get to move back into my house, having given up my job would I get any benefits? I will look for a job but know that they are few and far between in the area im from.

    Your initial claim would be suspended from any payment whilst they investigated the reasons why you left your job, the decision is made by someone in DWP that uses Decision maker legislation to make the decision. I think it's likely that you would be sanctioned but you could apply for hardship payments (which you may not get).

    You could get accommodation in a shared house whilst you look for work in the area you want to move back to.

    Surely you could afford to rent a room in a flat share on that - Hereford isn't an expensive area. You've already said that you like your job and another one could be hard to find.
