Help with Thomson Airline

Hi all, I put in a claim for flight delay on the 3/06/13 after a 4.5 hour delay from Manchester to Turkey (Dalaman) on 18/05/13.

I sent copies of boarding passes and booking details with the letter off of this site, edited to my personal experience.

It's 3 weeks today and heard nothing so I called and gave my booking reference and they said they have got my complaint but they don't reply for 100 days due to volume of claims.

They then further said they can send my letter out today and which informed me that I wouldn't receive any compensation as the plane I was meant to fly with was struck by lightning the day before and they used a different plane which caused a knock on effect over 24 hours later on my flight.

But when I got on the delayed flight I recorded the captain on my phone saying on an announcement that the delay was due to the original aircraft been damaged by a baggage handler on the fuel pipes. NO MENTION OF LIGHTNING?!

If I contested this with CAA and also sent my recording of the captain, would I be likely to receive any compensation?

    Hi, i am also in the process of trying to get compensation from Thomsons for a 5 hour flight delay to the St Lucia. I have been doing this since my first letter in November of last year (2012)and all I get is polite letters apologising but no offer of compensation. I tried the CCA but I think they are so snowed under it will be yonks before they get to me. Apart from that, they seem to have no legal clout. I have now issued a summons and am due in court soon to get this sorted. That would be my recommendation.

    That is the same excuse they give for my delay. The CAA are not worth contacting in my opinion

    I would send them a Notice before action, say for 28 days. Then begin court proceedings as this is the only way Thomson seen to me paying out
