Civil Enforcement Ltd, I need help please,

Hi all,

I am sorry about posting yet another thread on this but I have searched and I am just getting more confused on what to do, this is what happened,

I parked in a KFC car park which is in my local town in Feb this year, I have always parked there to nip into the shops, never had any problems before,

Then a few days later I received a parking fine with photo evidence, with it being a private fine I ignored the letter, I had other letters come from them after but just throw them in the bin,

My husband came home from work last Friday to tell me that he had been told the law had changed with these private fines, so now I am worried, I received a letter last week from Civil Enforcement Ltd, with a court claim form, saying they are going to submit this claim through Northampton County Court if I don’t pay £265, they then go on to say if I pay it before 26th June they will accept £150,

Can someone advise me on what to do next this is way over my head, I have until tomorrow to pay or I go to court, If I have to pay it then so be it,

    You don't pay. £265 is ridiculous, but you should NOT have chucked away the previous paperwork so that you could see what the original charge was.

    They are threatening court, No point now in doing anything until you get any Northampton Court papers (highly unlikely).

    Law change in this case is immaterial.

    OK. Accept your advice, but remember the "offence" was in February and OP has ignored for 3 - 4 months.

    Well, yes, it has changed way back in October 2012 - but it didn't suddenly make a fake PCN enforceable, as I ranted here when bored with the question about the 'new law' cropping up every single day in late 2012!

    Just means the registered keeper can no longer use a defence that they were not the driver. And it brought in POPLA (independent appeals) and certain rules that PPCs keep failing to meet. Hence the POPLA decisions thread near the top of the forum shows that recent reported decisions are wins for the motorist.

    But as you didn;t appeal you're probably too late for POPLA but see what kirkbyinfurnesslad advises you to write as he knows the score and is one of several of us on here and pepipoo who are helping people now threatened with court by CEL and Parking Eye (and a few others).

    Thank you all for the advice, I have never had a parking fine before so I had no idea the law had changed, so never have had to look on this thread before,

  • Hi, Can anyone help me. This is the first time I've used this site and not sure if I'm posting in the right place. My story. I had parked in a private car park to go shopping @ Curry's PC World Megastore. I had parked straddling two spaces. On my return, I noticed something stuck on my windscreen. It was a parking ticket from a private enforcement company stating that I was outside a marked bay. I have seven days to appeal and fourteen days to cough up £60.
    Could anyone advise me what steps I need to take or should I ignore the ticket.
