Actually if the PPC is holding the registered keeper liable by virtue of POFA 2012 then the amount can never be increased beyond what is on the NTK. So even if they start a threatogram chain when the NTK is ignored they cannot increase the sum demanded (well they can but it would not be backed up by the law). Here is the relevant part of Schedule 4 of POFA 2012

This does not, of course, preclude them from asking for costs in any court hearing. But it is an absolutely fair point to have an any POPLA appeal if the PPC tries it on.

I rather enjoy deciphering the exact meaning & requirements of POFA & the CoP & I can be so nit-pickingly pedantic that I think I must have been a lawyer in another life:)

So what should I expect in the post in terms of NTK? and how should I appeal it? Could anyone advice, or tell me where to find it on these forums -not sure where to look (stickies look like they were before the new law?)

    thanks

Wait for the NtK and then "soft" appeal ( use the wording below - thanks to Storma ! ) :

    Name
    Address

    Date

    Dear Scammers,

In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 3 of the BPA Code of Practice.

The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.

    Yours Faithfully

    Your name (printed)

Then wait to see what happens - come back here when you hear.

As I'm not yet at this stage I wanted to know what to expect beforehand.
  • I have had a similar today and i am quite concerned, i recieved a letter in the post from Euro Car Parks saying i need to pay them, as i overstayed by 16mins on one occasion, they have just changed the duration from 2hrs to 50mins, and i didnt notice, until today, but in the week passed i have parked there 5times for more than 50mins each time.
Are they likely to send me more 'fines'? do i have to pay them? or should i phone them ? and if so what do i say? i am worried as it will be £200 in fines which i really cannot afford, and if not paid withing 7days its will then go up to £350.
If you could please help i would be so grateful.
    Thanks

Soft appeal examples and then POPLA example wording linked here:

    https://forums.moneysavingexpert.com/discussion/4668167

Just make sure the soft appeal doesn't say who was driving - doesn't matter what you say as long as you are careful about that, as the PPC will no doubt reject a challenge.

And the POPLA appeal needs input form the forum at the time to ensure you are on to a winner with your strong appeal wording at that important stage.

I'd pretty much forgot about this issue until today, when we received a NTK.

    What should we do next?

I had assumed they weren't going to pursue it, I'm also not sure we have the original parking ticket anymore -not sure if we'll need it.
