But I guess the sticking point will be (playing devil's advocate here) is that there is no record of that the most attractive feature of this cruise is that it was an adults only cruise.
It might have been in the OP's mind but if the travel agent wasn't made aware of it then it could be seen as the OP just changing her mind about the cruise per se.2014 Target;
To overpay CC by £1,000.
Overpayment to date : £310
2nd Purse Challenge:
£15.88 saved to date0 -
But surely that's immaterial? If the cruise was advertised (in the brochure) as Adults Only and this is, in fact, incorrect then whether or not it was a stated requirement by the OP does not matter - the purchased service was Sold Not As Described (SNAD).0

That's ridiculous though. As someone else said, if it wasn't put down that the ship was an important part, does that mean they could change it to a narrowboat with no comeback?!
The allowance of children on a cruise is a significant change, whether or not OP mentioned that this was their primary reason for booking. Quite frankly, when booking a holiday, I don't feel the need to tell the travel agent *why* I'm booking it, nor should I have to emphasise which parts are most important in case they decide to alter that aspect significantly.
The holiday is now "not as described", IMO significantly so, and as such, the OP has rights to a refund0 -
OP, which brochure and cruise is it?
Older and newer edition brochures will be accessible online so someone can check you haven't misunderstood0 -
mo786uk thank you for the info re regulations you posted much appreciated.
JKKNE -it is in the latest edition of the Thomson cruise brochure (April)
this was/is the only brochure that you can get in the shops. (we went today to Thomson shop and asked for cruise brochure for this year she gave us the same copy and said only one available)
The inside front cover shows the cruise calendar from May 2013 up to Oct 2014, for each ship. it shows Thomson Celebration highlighted in blue for whole of July. with a * at the bottom of the page the * says where highlighted in blue this cruise is an Adults only cruise. The TA pointed it out to us, and said ouir cruise is "Adults only cruise".
however I tried to look online today at the brochure although its there you cant access it.
The manager of the shop we booked the holiday in, told me yesterday that each new brochure superceeds all others, but she also confirmed that that brochure was the brochure in use when we booked just two weeks ago.0 -

.
I'm viewing the December version and the Thomson Celebration isn't blue in July on that. Only January

this is the one i believe

it is not in blue so it may be that they have updated it online.0 -
it looks like they have, I just looked at your link, yesterday when I reported it you could not open the internet version. I never looked at the internet version before as I booked in a store with the instore paper version.
I wish I could get hold of the old internet version as I suspect it would have been in blue. I might need it if I go to advertising or trading standards
Thank you for your time.0 -
Since my response was on the other thread, and more recent discussion is on this one, I'll repost it here.
Personally I think "the fact that the TA did not put in her notes that adults only was important to us could mean we cant cancel with a refund and if we cancel we loose all our money" is Thomson talking out of their backside.
It's clear you booked an adults only cruise, and you have the brochure to prove it. If, in fact, children are on the cruise I'd consider that a major change to the holiday and insist on a full refund. If it came down to it, I really couldn't see a court siding against you.
For info, there's details of 'major changes' on their site, in which case they state they will offer you a refund. http://www.thomson.co.uk/editorial/s...agreement.html
I'd insist that this is a major change.0 -
