Foul water from extension draining into surface water drain. Who is liable ?

United utilities asked to survey my drains in January and I have had a letter today saying the foul water from my 9 year old extension shower room is going into the surface drains. Who is liable for this error, the architect who drew up the plans or the builder who did the work or the council building inspector who checked the drains ? I have spoken to Cheshire east council today and they say all their inspector does is to ask the builder about the drains when he comes out to a property. It is up to me to check that the foul water goes into the right drain apparently. Can anyone help please

    The architect if the drawing was wrong or did not address this
    The builder if the implementation does not correspond with the drawing
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Your architect or builder may be to be blame but you will be held responsible to get it corrected. You could try to recoup the costs from the guilty party whoever that may be.:o
  • Ive had the drawings checked and it looks like the architect is ok. Therefore, Ive got a builder that built it wrongly and a council building inspector who passed the drains when he should have failed them. Do I go after the builder first or the council, or both ?
  • Citizens Advice tell me that I can do nothing due to the Statute of Limitations. Apparently I needed to have commenced an action against the builder/council within 6 years. Are there any exceptions to this rule, as I have relied on the council telling me all was ok with the foundations/drains etc

    You are liable - I doubt that anyone will take any responsibility but it's worth a try
