Thanks to all your help with advising me to appeal my unfair ticket about 1 month ago.
I sent off an appeal to popla. I haven't heard anything yet until next week but I have received all the evidence that my car was parked there by the company that issued the ticket.
If it fails do I just pay the £100 the charge has increased to because I didn't pay £50 in time?
If I don't pay do they have the power to toe away my car like it says on the PCN?
Thanks all. (England)

If it fails you still do not pay, despite the fact you might think you have to; POPLA decisions are not binding on the public (PPCs hate that!!). So you would just be back to square one and ignoring debt collector letters like people have done for many years!
I have ignored 2 fake PCNs myself and still carry the scary letters to show colleagues about this scam.
Remind me, did you send a strong and long POPLA appeal written with our help with all the usual legal points and stuff? Hope so...if that is the case then you will win at POPLA. If not then it's not too late to add a strong appeal paragraph or two to POPLA because a weak (normal) appeal WILL LOSE!
P.S. What on earth do you mean the PCN says they can tow the car??!!!!!!!!!!! That is illegal!!!!!! Please show a picture of it and tell us which PPC said it!!!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes I took your advice with the legal wording and points and they haven't covered them all in the evidence they sent out.
Like giving me 7 days to pay after the appeal was rejected instead of 28-30 days as it said in the BPA code of practice. I can't get the picture on at the moment but it reads.
"After 28 days, we request from the DVLA registered keepers details as we now have reasonable cause to obtain them. An invoice will be created for £100 and sent immediately. Ignoring this invoice and our letters will add 40% debt recovery fees to the cost. If the amount is unpaid after 6 weeks (42 days) from the date and time of the incident, we are permitted to employ the services of a debt recovery agency. Meanwhile we may have permission to tow and impound the vehicle even if it does have a valid permit"

I was merrily reading the main body of your text above, thinking some of the points detailed by the PPC seem a bit bizarre - then I came to your final sentence - and guffawed so loud it frightened the cat.
'If my POPLA Appeal fails' ???
Then hell will freeze over the day after :rotfl:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If popla fails, just carry on with your normal daily routeen, and ignore the ppc begging letters, they may come in handy for emergency toilet paper, you never know when you could be caught short of the stuff. :money:PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:0

Definitely (not definately - for info) they're (check it out) not going to tow away your car. Court papers are more prevalent, but there's plenty of help here and on Pepipoo if needed. Please note, we are not a legal advice forum. A debt collection company can ask you for money like I can. You can tell both of us 'NO'.
In the unlikely event of receiving a 'small claim' you can get good advice on Pepipoo.
The only way they can take your car is IF you are taken to court AND IF the judge finds against you AND IF you do not pay after the judge orders you too.
So ignore letters from the scammers and only respond to genuine court papers, with advice from Pepipoo.Je suis Charlie0 -
