The Assessor's paragraph on the GPEOL is, from memory, a standard one used by all Assessors, which suggests to me that they have all been briefed on this by the Chief Adjudicator - and a template paragraph provided.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Well done!

I would be ITCHING to send 'N Martin' and Trevor Whitehouse a response:

Dear Trev the Clamp, 'N.Martin-who-doesn't-exist' and all the Hargreaves family at ANPR Ltd,

RE CANCELLED FAKE PCN NUMBER XXXXXXXXXX

I won at POPLA, as you will have seen. So your rubbish letter about 'warning hot surface' and slippery or wet floor' was as pointless as those viewing it on MSE forum said it was. My modus operandi dictates that I only deal in black & white, rendering your charge inevitably doomed at appeal. As you have now discovered to your cost.

Your misleading letter has been sent to the BPA Ltd with an official complaint..again.

    (up) yours

An open letter to all POPLA winners on GPEOL grounds

    Dear POPLA winner,

Congratulations on winning your POPLA appeal. The operator was found to be running a car park in breach of BPA guidelines by charging an amount which was not a genuine pre-estimate of loss.

However, if you drive by the same car park next week, you will find the same operator there, with the same signs, and still ripping off motorists.

Please could you consider giving some time back to the community and taking a few minutes to follow up your POPLA win.

Write to steve.c@britishparking.co.uk enclosing your POPLA win and explaining that the operator are running a car park in breach of BPA code of practice.

Write to david.dunford@dvla.gsi.gov.uk enclosing your POPLA win and explaining that the operator are running a car park in breach of BPA code of practice.

Write to your MP enclosing your POPLA win and explaining that the operator are running a car park in breach of BPA code of practice.

And finally, write to the Minister of Transport...you know the rest.

It shouldn't take more than a few minutes of your time; although the whole car parking industry is a house of cards, unless enough people start blowing at the bottom it won't come tumbling down.

Car parks can be managed in a responsible manner for the benefits of landowners and motorists, but the current methodology is not the way forward.
