cafcass always interview child 2 with father there, he's persuasive. yes i agree it is sad, splitting a family of 3 siblings up and taking the middle child away.... they always stuck together like glue. now they dont really interact, child 2 gets foreign holidays, children 1 and 3 just watch me financially struggle.
heigh ho.
incidentally cafcass also got their info wrong on me, (the safeguarding check) believe it or not came back as me having a conviction for child assault!!!! at a time when i did not live within the police authority's area!! and they took that as gospel truth, i had to dispute and query it with the police authority.
you couldnt make it up.
I have heard far worse stories of incompetence from them. As for the interview I believe their own guidelines suggest that the child should be interviewed separate from the parent to prevent coercion. Have you complained as I definitely would although it sounds like your case is no longer active in the courts?I think opinions should be judged of by their influences and effects, and if a man holds none that tend to make him less virtuous or more vicious, it may be concluded that he holds none that are dangerous; which I hope is the case with me.0 -
hi no i didnt complain or make a complaint. case is now closed due to the changes in legal aid i'm afraid. i have to live with it. and to be honest living with it is better than being in court and being abused and bad mouthed by him in front of the judge. His legal aid was revoked (too much income?) so he was pretty much able to say what he liked in court.
i know i'm probably a coward but i just got tired of it all. And i couldnt keep taking time off work either to go to court, some times he turned up sometimes he never bothered. And when he didnt it was just adjourned, so i'd wasted a day or half a day holiday.
worn down? yes very much so.
also (dont laugh) cafcass think i am an over protective parent... is there such a thing in this day and age?0 -
Report him to HMRC they will investigate a lot harder than the CSA will...
Explain in your contact with HMRC the fact that he has new car 3 holidays but declares no income and claims no benefit, and that this is causing financial hardship to yourself because as he has no declared income child support is not forthcoming.
At the moment that is your best chance of getting it corrected...!0 -
Would i be taken seriously or would they just view it as an ex making waves?
its disheartening to see what he has by "not workng" and i've had to turn down a free week in a caravan in the summer because i cannot afford the travel or even the spending money. I work 45 hours a week for that kind of life..0 -
They take every complaint seriously, they have no choice...!!!
Take the assessment you have for him to pay, photocopy it, send it in with a covering letter, explaining that the situation is wrong and as they have NOT done there job correctly by investigating him you are now losing financial support for your children, advise them it has been copied into your MP and that he is also helping with the CSA case...
It may take a while, but if they believe they have a chance of doing something then they will do basic checks etc 1st, like does he habve a mortgage, car etc, and if he does and has no income, they will look further into credit files, and credit debt etc, then if he has been spending money that has NOT been assessed or declared they will look at an investigation to follow under surveillance etc...
If any or all of this is assessed, then they can backdate estimated tax for income, this may not be notified to you, but you can ask not sure it will be done, but ask anyway, for it to be forwarded to the CSA so they can investigate previous assessments...
You have nothing to lose...!!!0 -

you'll probably never know...but report him regardless because it's not acceptable. And at some level, I suspect the HMRC relies on the information of ex partners when it comes to tax evasion! You have nothing to lose - they'll investigate or they won't. Just tell the truth - you can do it online, anonymously if you want to. I regularly point out my ex's numerous websites to them. No obvious action taken but I assume one day it'll all add up at the right moment and he'll be in trouble...Hope so!0 -
ah thank you so much for the advice i shall compile things this weekend.
again many thanks0 -
ok, the saga continues, after receiveing multiple letters from the CSA which i do reply to and question they have decided my complaint is resolved (to their eyes maybe not mine) they havev written to my mp saying i am happy wit the resolution. However, they havent replied to my last letter to them, sent within the timescales (of which are ridiculously short anyway)
what should i do now?
any ideas?
do i contact my mp again saying that they havent resolved it correctly?
and should i complain again that they are sending multiple letters from different postal regions/offices and not from one centralised easy to respond to source?
i'd appreciate anyones input/thoughts.
thanks0 -
What a shocking story ...its another example of the CSA going after the easy target. We have had years disappointment through the CSA. Have a look at some of my posts since I joined last year. We are still much in the same predicament only the 2 qc's haven't been attending their college courses since last year yet we are still having to pay because the pwc claims Ch/ben & off course all the other things that go with it ! The CSA aren't really interested in Child Support are they or the people like your ex wouldn't get away with what they do would they & we wouldn't be in situation we are in ? Surely a few quick phone calls to relevant agencies would give them all the information they need! No excuse in 21st century when everything is available at the touch of a keyboard! CSA said to our MP we were happy with their reply..were we ? That's news to us ..we were still waiting for a reply to our queries! The CSA seem above the law .....solicitors wont touch them ,CAB wont help you when it gets down to the facts that you think you've been mistreated by them, the media isn't allowed to you get involved .. couldn't make it up !0
