blooming CSA

Options
hi

just a quick question or two.

csa taking payments from my salary by DOE... i got my mp involved because we have a resident child each and i get no money from him. they replied to me after my mp's letter. I am of course disputing things and asking more questions via letter. ( i have no intention of speaking on the phone to them) anyway, should i copy my mp in on the corrspondence they send me?

also should i request that after they have done a monthly DOE on me that they then deduct from that sum what he should pay me and return it to me?

is that feasible? or am i right in thinking that while they have me under a DOE they are "ticking" their performance boxes and i can go whistle?

    hi

no but yes!! under the radar builder, handyman, mechanic car buyer and seller (trader).

and despite me telling the CSA this for over 10 years they still say he doesnt earn anything. Yet they also believe he can live on no income, no wages no benefits. Multiple foreign holidays a year and a new car.....

i have done the inconsistent lifestyle forms yet they just send them to him to see what i say and obviously refute.

You need to send them hard evidence of his lifestyle. Hard to get but your not going to get Anywhere fast.

Why are ou on DEO? If they have assessed him as having a nil assessment then they wont deduct anything back to you, because nothing is due to you.

Its not right, but its the way it works..

i have asked them to check his bank accounts and his passport movements. but of course they just believe what he tells them.
his assessment is £5 per week.

i'm on a DEO because i rocked the boat and argued the toss and wouldnt pay until they listened to me.... guess that went wrong ha !!!

i cant even afford a holiday for me and my son yet a "non working" person can afford 3 yes 3 foreign holidays a year... and that is before you even take into account the wedge he gets from me.

it baffles me but i suppose as long as they are getting a working parent to pay money they feel they have done right.
I've never had a penny out of him in 10 years due to his floating under the radar yet i am hammered straight away,.

i appareciate it isnt always clear cut but seems unfair.

anyway, back to the other question should i also forward copies of further correspondence onto my mp or not? i'm unsure about that

It is unfair, but be proud that your supporting both your children. How old are the kids? Does the child living with hum have regular access with you and the one with you go to the dads?

I would keep your MP in the loop. Wont do any harm. I don't have any experience with tribunals etc and I wonder how far you can push it.

thank you for saying that. For 11 years i have solel supported 3 children. child 1 now 18, child 2 with dad 15 (been there 2 years) child 3 13.

nope, he refuses to allow me or cafcass to meet with child 2 says she doesnt want it. When cafcass have forced the issue he sits in on the meetings.

yes child 3 sees dad when ever he drives up to see him. we live in a different city. despite the courts saying contact should be non direct i never turn him away or refuse to let him see child 3. oph and he never makes appointments or sets dates, just turns up on my doorstep when he sees fit.

like you say at least i can hold my head up knowing that i have paid my way.

Child 2 is old enough to have their feelings taken into consideration by a court. I cant believe CAFCASS have not pushed it? Thats really sad :-(

cafcass always interview child 2 with father there, he's persuasive. yes i agree it is sad, splitting a family of 3 siblings up and taking the middle child away.... they always stuck together like glue. now they dont really interact, child 2 gets foreign holidays, children 1 and 3 just watch me financially struggle.

    heigh ho.

incidentally cafcass also got their info wrong on me, (the safeguarding check) believe it or not came back as me having a conviction for child assault!!!! at a time when i did not live within the police authority's area!! and they took that as gospel truth, i had to dispute and query it with the police authority.

    you couldnt make it up.

child 2 doesnt appear to get my letters or cards, i think they assume i've forgotten them. and with a father not trying to encourage contact it makes it difficult. He doesnt even bring child 2 up when he visits child 3.....

and these days with paying so much out in CSA i cant afford a car or the travel expenses to get down to child 2

Have they got your assessment correct? Taking a reduction for the child in your household? You should be paying 15% of your net income. Unless you hve arrears.

unfortunately they have now got their sums correct and yes i'm paying off arrears too. But funnily enough they dont want to chase up other parents arrears. Every time i question this they just say they have written to him but he hasnt resonded.
