  • I have now received a County Court Claim Form, how do I proceed now ? Any advice would be much appreciated.


    Did you not receive a Letter before Action (also letter before claim or letter before county claim) first?

    You inferred the matter was being referred to a debt collector in first post - then next time you come back you've received a ccounty court claim form? - There's a missing link here - debt collectors cannot issue court claims - only the oringal creditor or their legally authorised solicitor can.


    As KIFL says - we really need to know the parking company here to help - perfectly safe do so.
  • The PPC is BSG Car Parking Management. It is they who have issued the court claim. I received a letter from their solicitor stating that BSG may instruct them to take legal action. This was followed by a letter before claim.

    Interesting. So is the 'claim form' a real sealed one from Northampton or a 'look at what we might do' copy attached to a solicitor's letter? If it's a real one I would post on pepipoo forum as well and look at other court case threads on there first as there are LOADS to learn from already:

    Go back about a dozen pages reading ALL other court threads (any PPC, mostly ParkingEye and SIP and CEL at the mo) before you then jump in and post your own. Here's some info to start with about the process:

    The say you were parked on the road way, however you say you were parked on a car park in front of your garage.
    Does the garage lead straight off the car park or is there a lead into the garage?

    Do you own the garage or rent it?

    Do they say you need a permit to park on this estate?

    What does the POC say?
  • I was parked in front of the garage which I own (leasehold) in the car park adjacent to it. It is off of the road and the car park leads directly to it. There are no permits to my knowledge. Every apartment has either one allocated parking spot or a garage. There are no visitor spaces at this block of apartments. Sorry, what is a POC ?

    POC = Particulars of claim, what have they said you did to owe them money.
  • Oh I get it - particulars of claim !

    This just gives the date and numbers of the two PCN's the systems that the claimant claims the sum of £339.11 for parking and enforcement charges. This is followed by details of the charges and interest, but no details of the ' offence'.

    Oh my word their not going to get far with that, does is say anywhere full details to follow or will be sent later?

    If there is not a permit system then I assume no one is allowed to park anywhere and there are signs erected to convey this?
