Faulty Handset less then 12 months old, what are my rights?

Hi All
I have Samsung Galaxy S3 that is about 8 months old. The handset has developed a known fault. I have phoned Orange and they said that they will replace the handset with a 'reconditioned' unit. I argued against this and said I would speak to Samsung. Unfortunately there offices are now closed for the evening. But can Orange do this?
I thought law stated that any product that breaks within 12 months should be replaced with a brand new item or full refund given?
Please advise?

Hi, usually they offer to send it away for repair or you can send it direct to the manufacturer.
You thought wrongly regarding an automatic replacement, they will want the phone checking to ensure there is no physical//water damage and only if it is a genuine fault will it repaired.
I very much doubt you have any chance of a refund.0 -

When my hoover broke within 12 months I returned it to the shop and without question it was replaced with a new unit.
Or is the rule just different for mobile phones?0 -

No, just your Hoover retailer went above statutory rights by replacing it.====0 -
