Severn Trent Missing Bill

We are very fortunate in that we are debt-free (other than a mortgage and a few hundred pounds on a credit card) but have just been put into a very stressful situation by Severn Trent Water. We have just received a notice from county court claiming we have not paid our latest water bill. In 7 years we have never missed a payment and have paid on time, as soon as the bill arrived but for some reason, this time we did not receive any paperwork at all. The precendent for mistakes lies with Severn Trent as when we first moved in, it took almost a year to get registered as customers and not 'The Occupier' and the bills were all over the place. We cannot get anyone to listen to us, have sent the payment as do not deny we owe this amount, just didn't know it was due! It is actually causing a lot of stress, filling in a defence claim on a court form and the prospect of having our credit rating affected when we are in the process of getting married and buying a new house. We feel utterly powerless and wondered whether anyone had any advice? Why should the entire burden of proof lie with us when we have been exemplary customers and why did they not ring if they were getting no response from letters? It is very frustrating and upsetting so any words of wisdom gratefully received!

    I think you might be better putting your query in a forum dealing with legal matters as the situation could arise with any outstanding bill, not just water.

    I am no lawyer, but I am surprised that it has gone to court as it normally takes many months after payment is due and especially as you have now paid. As a matter of interest how did you send payment if you didn't receive a bill.

    I am not clear what Severn Trent are trying to achieve by going to court if you have paid in full. Are they trying to claim expenses etc?

    Even if Severn Trent have your phone number, I believe that there are restrictions on phoning as it can be construed as harrassment.

    The "entire burden of proof does not lie with you". Your defence is quite simple as stated in your post. The court will examine all of the evidence and decide if, basically, they believe you are telling the truth about not receiving bills and reminders. If your bills have always been paid on time, that may count in your favour.

    I would go and see the CAB, or a lawyer if you can afford one.

    Personally I doubt if it will ever get to court as Severn Trent will withdraw the action if events are as you descibe.

    I didnt know severn trent affected your credit rating, ive never seen them on my credit reports

    I believe any court order against you can appear on your credit report.

    You posted in another thread that your father has not paid Severn Trent for 3 years - presumably he has a court order against him?

    nope theyve threatened court action but never taken him to court
