NIP for Contravenining Red Traffic Light

I received a NIP on 15th May 2013 for a red traffic light offence which took place on 9th January 2013.

I responded requesting evidence, and as expected this was inconclusive. I have received my 7 day reminder requesting name of the driver.

My issue is that I have a company Car, and therefore along with me, my family and friends also use my vehicle. Anybody I give permission to is insured, and I have asked all that may have used the vehicle but its impossible to recall who may have been driving especially so long after the incident. I have only tomorrow remaining to respond. I do not know what to do. any ideas please?

It's quite a long process, but you should ask them for a photograph of the driver to assist you in identifying the driver.

I have already received this but it only shows the rear of the vehicle jump the lights and not the driver hence inconclusive.

That's the point, you need to ask them to help assist you in identifying the driver, as you cannot be sure who it was.

    Makes their evidence look weaker

so should I just send another cover letter to them explaining it is a company car and the incident is nearly 6 months ago and I cannot recall who was driving. I am even happy to state that they can give me the points to close the case but I cannot be sure If i was driving...?how else would they assist me? im assuming they have no further detaisl its just so long ago to remember.I cant even if i tried

Definitely do not say you accept liability, just send them a letter asking to assist you with identifying the perpetrator, so you can pass on the correct details.

Certainly explain there are multiple drivers and you cannot be sure because of the time lapse.

The RK can be held liable for this, if no-one else turns up. But you can legally delay it this way, which will give you time to find out who it really was.

If it wasn't you, should should not accept liability. Your insurance will sky rocket (if you have, or plan to have a private car)

What time of day was it? Would you of been at work? If you fail to respond naming somebody you will be looking at a s172 charge and 6 points and £500+ fine.
Insurance premium increases for the next 5 years.
If you believe it would most likely be you, then naming yourself may be the best option for you.

It wont be delayed and how can the delay help identify the driver?
If they send the s172 back saying they are not sure, the next thing they will get is a court summons within the next 6 months.
The offence will be failing to name the driver and you need to prove you have used reasonable diligence to try and find out. Saying you cant remember will not do.

His insurance is not going to skyrocket with 3 points. But it will for 6 points and a S172 charge.

If its a company car the nip would of gone to the lease company first. Which rules out the 14 day time limit.
