But surely if they do succeed in getting you as much as possible, and the sale price is higher than valuation, then their commission will be based on the lower amount, that being a win for you...?

Every EA near you does this?! Very strange.
If things are moving near you, I would be tempted to try an online agency. Either that, or try to negotiate with them re their fee being at sale price, and no fee to come out of the deal.
