Strange one and not sure right forum but I will give it a go and see if anyone help!!!
I have discovered that an American company have used some video footage of my son in a commercial.
The video footage was taken at a football match. He was in the crowd.
Can this company use this footage without his permission?

How on earth do you expect them to contact everyone in the clip and ask for permission? What harm has it done?0

As far back as 1979, I was at Earls Court to see Pink Floyd perform The Wall and on the ticket it clearly states that images may be used in a forthcoming film and purchase of said ticket implies permission given.0 -
It hasn't done any harm Matty but I am interested as I know the data protection act in the Uk would not allow this unless permission had been granted. It was a ticketed event so I suppose it may be hidden in the T's and C's as per torbrex's reply0

Who took the video footage - the copyright rests with them.
Your son was in a public place with TV cameras.0 -
What data would the Data Protection Act protect in this case?0

I am watching the live cricket and can see thousands of people in the crowd. Can't see the issue here. You go, you get filmed. As has been said, this is considered a public place, and filming is completely legalOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

You only have "possible" recourse if he's identifiable and it's implied he is endorsing a product.
I seriously doubt that is the case with just being in a crowd.0 -

What is the whole point of this? Is the op trying to get money, get whoever filmed it into trouble or what?
Seeing the op says it hasn't done any harm it must be one of these two things!0
