Civil Enforcement ltd Whitby CO-OP

Hi we have received a PCN from this company following a misunderstanding of the sign's in their car park:(. We parked for less than the indicated two hour free parking limit and shopped in the store which I can prove if necessary through my bank statement, although I no longer have a receipt.Our only mistake it would appear is we didn't obtain a £2 parking ticket and then claim a refund in store. Part of me thinks I should just pay and put it down to experience but even at their offer of £45 if paid within 14 days it feels like robbery. Any help or advise would be very gratefully received,I do not live in Whitby and was on holiday at the time so can not check the exact wording of the signage.

    Obviously you shouldn't pay this scam invoice, go back to the coop and demand that they sort this out, show a redacted bank statement to the store manager if you need to.

    You need to know that this company do on occasion take people to court, to circumvent that you need to challenge this, if they reject it you need to take this to popla the independent appeals. I gather they sent you a Notice to Driver as it was through ANPR cameras on site yes ? Did you get it within 14 days ?

    In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out

    The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

    Hi Stroma and thanks for your swift reply. Yes it was through ANPR cameras and the letter arrived on day 14 if you count the day after we parked as day 1. I contacted the store by phone on the day we received the letter and the person I spoke to was sympathetic but said there was nothing she could do as CEL ran the car park not them. She did give me the 0800 number for customer services but I think that was just to get rid of me.

    Of course it's something to do with them, for shame that the ethical coop has unregulated cowboys in their car park! Go straight to the top with this, search for the ceo of the coop and send them an email with this.

    As for CEL send the challenge I've posted above, don't alter it just put your details on there, and the date and ref number etc.

    Thanks Stroma I will take your advise and I will also drop a letter to the store manager. If anyone viewing lives in Whitby would be kind enough to confirm the signage allows up to two hours free parking for customers I would be very grateful.

    You should also take time to check that the PPC has complied fully with the requirements of POFA and the BPA guidelines on their documentation.

    They have met the timescale and you are hampered by not living near the Co-op, but do read the POFA section 4 and BPA COP here http://www.britishparking.co.uk/write/Documents/AOS/BPA_CodeofPractice_2013_v1.pdf

    If they have slipped up in any way, then it goes in the POPLA appeal.

    Hi ,thanks to all who have so far offered help. I have now sent strongly worded letters to the CO-OP store manager and customer relations at their head office in Manchester along with proof from my bank statement. I will give them a few days to see if they call the dogs off before I send the letter to CEL. Thanks again and I will post back when I next hear anything.

    Hi all ,following my letters to the store and customer services,there was a message on my answerphone yesterday from customer services saying they had requested that the charge was dropped on my behalf.I have kept a recording of this just in case but hopefully common sense has prevailed. Having read Stroma's post about certain PPCs not meeting the conditions in the POFA, my PCN fom CEL certainly does contain the inference that they can recover the charge from the keeper,so I may consider complaining to the DVLA. Interestingly no mention is made on the PCN of who the creditor or land owner is I wonder if this contravenes any regulations. I will post back when I receive a definitive cancellation of my charge from the CO-OP or CEL. Thanks again for the help and advise, this has been an eye opener for me and you guys really are doing a public service which is very much appreciated.:money:
