Another Egg / Canada Square Operations query!

Sorry - I've had a search but can't see a similar scenario, apologies if anyone has to repeat previous advice on this!

I had an Egg card about a decade ago up until about 5 years ago or so, and I'm 95% positive I paid PPI on it when I didn't need it. I made a request to Barclaycard for a copy of my credit agreement & enclosed a cheque, and also asked for the T&Cs.

They refused the request as my address had changed since having the card. So I called up & changed the details, and resent the request. They then told me to redirect my correspondance to;

Egg
Riverside Park
Pride Park
Derby
DE99 3GG

Canada Square Operations then wrote to me saying that the address details do not match what's on their system, asking for proof of current address. So I sent them that, and they replied with another letter saying;

Thank you for your recent request for an executed copy of the credit agreement for account number ***** with Canada Square Operations etc

As the account you refer to is now closed I have to inform you that Canada Square Operations are under no obligation to comply with a request for a copy of the executed agreement under the Consumer Credit Act as we no longer have a contractual relationship to this account, nor are we seeking to enforce any agreement on the account.

The right to be provided with this information from Canada Square Operations ended with the closure of the account.

Section 78 (3) (a) of the Consumer Credit Act states that section 78 (1) does not apply where 'no sum is, or will or may become, payable by the debtor'. The right to request an executed copy of an agreement is found in Part VI of the Act, which is entitled "Matters arising during currency of credit or hire agreements"; so where an agreement is no longer current the right to request or be provided with a copy of the executed agreement therefore ceases.


I think I did a balance transfer to another card towards the end of the account, but I was sure that when Barclaycard took over the credit card I got a letter saying that the account was closed (I might be wrong). Is there any advice anyone could offer in this situation? Apologies for the length of this post!!

    Send them a SAR and £10. See the front page sticky. They have a habit of interpreting the SAR as a section 78 request, so if they write back after you send them a proper SAR [Subject Access Request] complain to the ICO and they will make them comply.

  • You need to send an SAR request to Canada Square Operations at their Worthing address. Enclose a cheque for £10 and an ORIGINAL of a utility bill or bank statement.
    I write original in block capitals because if you don't you will get the run around from them like I am, copies will not suffice. Once you get your SAR and put in your PPI claim, you will still find yourself sending them yet another original of a utility bill as they will say they haven't got your address, even though they send the SAR to it and there is even proof in the SAR which is verified by themselves that you have already provided them with your address!!

    The SAR will give you all the information they have on you, they might say they can only go back 6 years but I got everything which dated back until 2001.
