Looking for a spot of help. Like to think I am an "expert" in many fields but not this one.
My Mrs was sent a potential PPI miss-selling form from RBS relating to a loan agreed back in July 2006 over the telephone (she thinks).
Now before working out whether we have grounds for any complaints. (She was actually self employed around that time. )
I thought it advisable to read the loan/ppi agreement.
Cannot find it so sent a tenner and requested from RBS the copy of the specific loan agreement.
Not quite sure why but RBS seem to be sending out lots of letters for my tenner. Examples such as we can find no evidence of you having a mortgage etc !!!!!!!!!!!!!!
Also received today in a recorded delivery. A load of Credit Card statements !!!!!!!!!!! and financial info for a woman 450 miles down the road !!!!
After phoning complaints we were notified we should have received a letter stating that RBS cannot find a copy of the agreement. I assume it is lost or shredded. Something must have been kept on computer I suppose for them to have alerted us in the 1st place.
Anyway to cut to the chase does RBS not having any paperwork put them in a poor position to defend any complaint ?
Will there be the possibility of a phone record from 7 years ago ?
Advice on how to proceed anyone please ?

Big computer sends out letters to anyone who has had PPI to allow the timebar clock to start ticking. It wont know what documents exist, if they were mis-sold or not or anything else for that matter. Going back to my banking days, the code of loans with PPi was different to those without. So, the computer could identify those that had it going back over a long time. However, the filing of agreements in those days was poor. Stuff them in a filing cabinet and every year destroy the ones over 6 years old.Anyway to cut to the chase does RBS not having any paperwork put them in a poor position to defend any complaint ?
Actually, it puts you in a poorer position. The evidence has to support your allegations. If you cannot provide evidence, the firm has to use its own evidence to see if your allegations were likely. If no evidence exists to support your allegations, they can reject the complaint unless another failing is identified or you get lucky with an auto payout.Will there be the possibility of a phone record from 7 years ago ?

Most exclusions tend to be fairly generic. Self employment is the big variable with some plans covering that fine whilst others have onerous terms and some outright dont cover it.

What possible benefit or not as the case may be, was there for someone self-employed with the RBS PPI.
That apart from the Mrs being gullible, which does not seem to be a good enough reason to challenge.0 -
Do you have the account number? I telephoned them and asked for details , eg when did I take out the credit card, was it via post / online etc when did the ppi get added etc then took it from there0

RBS right now do auto payouts for people who were self employed when they took their policy out. Also them not having the agreement puts you in a better position to argue your case so long as you remember what happend accurately. If they dont have the credit agreement then they will not have on their system what her employment status was at the time. So really they're not in any position to defend the complaint.
Your only worry here is if they have a call recording and your Mrs told them that she was full time employed or working over 16 hours or if your Mrs told them she was self employed, they brought the exclusions to her attention, but she still wanted to purchase PPI. They very rarely have call recordings though, so I think you're in a chance for the monies.0 -
Auto-payouts are a business decision usually based on smaller claims amounts. No investigation takes place and the Bank offers a "goodwill amount" to stave off paying the FOS fee and so paying out even more.RBS right now do auto payouts for people who were self employed when they took their policy out.
It has absolutely nothing to do with being self-employed (or any complaint reason).0
