TESCO ~ SOUTHEND ~ RBS WORKERS .... Company doesn't have enough space ... daughter starts company .... saves for a car ..... now gets fined for sitting there 4 to 5 hours ... HighView Parking does she have to pay ??? spends money in Tesco both morning and lunch EVERY SINGLE DAY OF THE WEEK !! appears unethical .... Can Law Enforce this as it is not Police and is not Council ??? various OPINIONS ON FORUMS ... BUT OPINION IS NOT ENOUGH ... FACT IS NEEDED .... many thanks

No. If it's not council ignore it. Don't respond at all. They will mail you invoices, just bin them. But I'd find somewhere new to park.0

She probably doesn't have to pay it. But why does she think Tesco should provide her with free car parking for the day?0

Fact 1 - she shouldn't be abusing spaces to be used for Tesco shoppers. If her work doesn't supply spaces, take the bus, or park in the street. It s because of her actions that Highview and their like exist.
Fact 2 - if she continues to park there, Highview will quickly realise this and arrange to purse her (legally) for the contract breach. As a one-off, there will just be a flurry of begging letters.0 -

That's the best place for such questions. It's speculative invoicing which has no legal basis and is easily challenged. The only ones that are enforceable are PENALTY Charge Notices ... PARKING Charge Notices may be worded to LOOK like fines/penalties, but they are not.0 -
I shop at this Tesco. The car park is almost full all the time. Isn't there a park and ride provided by RBS?
I must say, I wouldn't work there if I couldn't drive to and from.

Yes, it is unethical - your daughter is using the Tesco car park all day. It's not their problem there isn't enough parking - that's your daughters problem to sort out.
Ignore the letters, but tell your daughter to be more considerate. They didn't build the carpark so employees of other businesses could dump their cars on it.0 -

As for the OP's daughter, she's taking the proverbial, and for once I'd be on the side of the parking company. I'm sure she could get them off her case by paying the posted parking fee every day, although pimento's suggestion is probably going to be cheaper (I'm assuming that is actually somewhere near to where she works).0 -

As for ops question, they have tried it in court a few times and lost, so it could easily defended and won if you are the one in 10k they pursue (and if you have a file of tickets you may well be).
However it doesn't change the fact your abusing the land and its intended purpose.0
