MBNA PPI Complaint.

We recently made a PPI complaint against MBNA.They dismissed the claim.I then sent them a FOI letter.Amongst the information i received was a copy of the original mail application showing the area where you tick for PPI or not was blank.This is an old account and i believe the Ombudsman only looks at complaints going back six years.Just wondering where we can go from here,thanks for any help in advance.

    The FOS will look at complaints where the firm was regulated at that time. However, what reason did MBNA reject your complaint? if they say you didnt have it and the evidence supports that, then what do you have to show you did have?

    BTW, FOI does not apply to firms. That is Government. Firms have different legislation that falls under the data protection act and what you did was a DSAR.

    Thanks for prompt response.Yes it was a SARS letter. They accept i had PPI and are telling me this was sold over the telephone which i have no memory of and there is no evidence of this in the information they sent me.They say the sale was made on a non-advised basis.I have the copy of the mail application form and the box for PPI has not been ticked.I guess the next step is the Financial Ombudsman,thanks again.

    Most PPI was sold when you activated the card, if you had a good sick package from work, life insurance,savings or other means to pay the card back should the worst happen, I would write back to them and reject the reason they gave for not upholding if any of the reasons I stated above applied to you, also, ask the question
    " why would you not take the PPI on the application but then take it during a phone call " what was said to make you go on to take this and why did you not take it initially?.

    Give this a try, it may not get you anywhere but you won't know until you try.
