council: ending tennancy problem.

Need to end a tenancy . Council wont end it until keys are back.
Person is sorting out end of tenancy(or suppossed to be) for old person.

Now person who is supposed to have told council that tenancy will end has not, and we suspect they want it for themselves to live or rent it pretending it is still in old persons name.

Phoned council myself to end tenancy,once we realized the other person had not informed them.and they will only end it once keys received as we live far away, we cannot sort it out.

Is there anything we can do once property is vacated(or old person has moved out) to get the council to end the tenancy on the day he moves out.

    I can't read the council tenancy agreement from here which (should..) state what notice is required.

    The tenant (or one of the joint tenants) should write (yes, WRITE!! - keep copy) giving notice. & Return keys, getting receipt, when possible. If notice valid that ends tenancy.

    Are you the tenant/one of joint tenants??

    If any ONE of several joint tenants writes giving valid notice then that tenancy ends, for all tenants: landlord (in this case council..) then have problem if any of the other joint tenants don';t leave & council will have to evict them.

    Who is the "old person"?? Someone you know/a-relative/bloke-you-met-in-pub??

    What is your involvement in this?? Neighbour, relative??

    As above, notice normally has to be given in writing. You cannot just ring and tell them you are ending someone else's tenancy, otherwise I could ring your landlord and end yours!

    Who has the "old person's" keys? Is this "other person" a joint tenant, relative etc of the "old person"? Do they have a key? Are they living in the same property at the moment?

    What connection are you to the "old person"? Where is "old person" moving to? Have they been given another property, going into care, moving in with relative?

    If you cannot do anything to help the "old person" end their tenancy in writing, then you can wait until they have moved to their new property and tip off the council that there may be something fishy going on and suggest they make an inspection of the old place, but it would be better for all concerned to do this upfront and formally now. Old tenant remains liable for the property until notice is accpeted and keys returned, so there needs to be a formal hand-over, otherwise who knows what damage etc may be caused between "old person" leaving and council regaining possession ...

    it is a single tenancy(old persons tenancy)
    nobody lives at this address apart from old person
    A (famil;y) is helping move old person out of property into another one E-S.

    A stated to us(family) that they had informed council of end of tenancy to tie in with notice period, which we have found out is incorrect, thus no notice period

    We believe that A is going to keep the house, either to rent out or use themselves.

    I informed the council about this, and they did not say anythi ng, just keys have to be handed in to end tenancy. Even after i explained situation they still only said this.

    this is what we are worried about now, that we now have to give written notice ( month) and anything can happen to the house inbetween with old person being responsible.

    If you must get involved, as I said earlier, wait until the old person is safely moved into their new abode, and contact the council then, with the news that the property is being illegally sublet and the legal tenant is now living at XXX address. Councils do normally take subletting seriously but it has to actually be happening, and not just your suspicion that it might happen, before they can act.
