    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Stroma makes his position clear, as do others. Read the thread, listen to the arguments, and make up your own mind based on what has been said and how you view the issues.

    It's a strange situation when the first thing a Registered Keeper knows about a fake parking ticket is when a notorious debt collector letter arrives out of the blue.

    Do you not have a Notice to Keeper in your template letters? Have you lost your diaries or simply cannot count up to 56 days?


    Have you read schedule 4 of the Protection of Freedoms Act 2012 or is UKPS not bothering to invoke keeper liability then?

    As such, you will know that there is no possibility of registered keeper liability without a compliant NTK being sent to me in time after the alleged parking incident. You will also know that I have no legal duty to divulge the name of the driver, so I won't. As well as arguing 'no keeper liability' my appeal includes the fact that any charge is not a genuine pre-estimate of loss and so breaches the BPA Code of Practice, and that UKPS do not own this land so have no legal standing to allege any loss.

    And you will know - I hope, as UKPS are AOS members for some reason - that you now have to either reject my appeal or give me a POPLA code. If you don't, particularly if you obfuscate and pretend in some template reply that the driver has to be named, then I will immediately report UKPS to the BPA Ltd and DVLA AOS Compliance Managers.

    PCS: Now that PCS know this charge is disputed you must pass the file back to UKPS who must address my appeal as Keeper, in response to this sorry attempt at a 'Notice to Keeper'. Take formal note, regarding the OFT debt collection guidelines, that any further contact from yourselves (PCS, DRP or Zenith or whatever you care to call yourselves) will be considered harassment and a breach of the DPA since you no longer have cause to store or use my data under these circumstances where an alleged debt is denied and disputed. I will report PCS to the CSA and OFT, as well as to the Information Commissioner, should you contact me again about this matter.

    UKPS: accept or reject my appeal within the required 35 days.

    The letter is a notice to owner and has my details on it , it is the first letter i have had after the ticket, i have had no other correspondence with them.

    Yep which is why I said to send that reply. The green/white PCS letter they call a 'Notice to Owner' is not a compliant Notice to Keeper, in too many ways to list!
