    Developers of estates of houses want to get rid of all the land - there is no reason for them to end up keeping visitor's parking spaces - they would just be an administrative hassle.

    So what do they do? They transfer the spaces to individual house owners, but make them subject to the rights of others to use them. So a particular owner may think he has more spaces than another but actually he will not have exclusive use of any visitor's spaces that he may own. This is no different in principle to ownership of an access way subject to the rights of others to use it.

  • I've been in roughly this situation. I owned a leasehold ground floor flat for several years. There were two "parking spaces" next to the flat. One space was regularly used by the owner of a cafe that was part of the block. The other space was unused. When I bought the flat I enquired about the space. The shop owner told me he "owned" the parking space he used. The agent for the freeholder told me they would sell me the space and when I asked how much they replied they would like as much as possible and I should make an offer!

    So, I did the obvious thing - I parked on the free space and used it without any problems for about 5 years until I sold the place. I don't think the cafe owner had ever paid for his space either, but everyone just assumed that we both had.

    We have a simular situation with a path that run between our back wall & our parking place. It is registered to next door who hasn't got a parking place just grass. No actual dispute yet even though our neighbour has objected to everything that has been done to our house.

    Parking is so emotive. Just be really sure you want to buy into this ambiguity and potential fraught neighbour relations. Good luck.

    Definitely.

    And BS from EAs doesn't help the situation either.

    Just last weekend we viewed a house on a bit of a rat-run where street parking is hard to come by. The EA told us in all honesty that residents tend to 'stick to their own parking spots on the road'.... yeah, right! :rotfl:

    In all three houses I have owned there were shared areas,

    2 houses sharing a driveway between the houses, where I owned the left side, but am forced to give 100% access and them owning the other side, and them forced to give me 100% access.

    7 houses sharing a court yard where there were 7 garages. Each house owned the bit in front of their garage, but the houses above and next to the drive and Tunnel that led behind the houses owned parts of the drive, and all had to give access. It was clear that parking was allowed in front of each garage.
    Upkeep was down to each person, so in the event that it became a danger, you would be liable if someone fell over on your bit.

    Current house is a PITA as next door does not have a car, our garage is too small for most car repairs, and yet she complains if I do repairs in the shared drive. I leave plenty of space, and make sure it's all left clean and tidy, but she always likes to point out that the access over her land is so I can get access to my garage.
    Actually she shut up when I told her I was too poor to pay for repairs and if I didn't get the car fixed before monday I'd have no way of getting to work and I'd be sacked. That was about 4 years ago, and she seems to have come round:rotfl: (I had a back up plan but hey) :T

    Are you mad? You simply cannot move in without this being absolutely 100% crystal clear, or you are simply moving in to a world of pain. At the very least go and have a chat with your potential new neighbour.
