Hi everyone,
In January I went to move my mortgage and was told, to my confusion, I had failed the credit check! On investigating there were 2 fraudulent wonga loans on my credit file! It has finally been sorted out today
My question is, ia tgere any way I can claim back the extra 2.2% I have been paying on my mortgage whilst this has been going on?

I don't really know. Wasn't sure if there was maybe some sort of fund? We had a baby in January so the extra money we had to pay could have been much better spent0

No - you could try a claim against Wonga for erroneously blighting your reputation but the chances are they would say they were defrauded, and your blight has been corrected.0

There isn't of course, but if there were, who would you have expected to pay into it and why?0 -

Yes, I would say that you do have a case. You would have to sue Wonga and you would have to prove to the court what your loss is, i.e. the extra that you have paid due to Wong incorrectly reporting a default.
It is not your fault that someone made a fraudulent application on your behalf. It is Wonga's responsibility to record data accurately and if they have made a mistake and they should be made to rectify your los. It is one of the costs of their business model.
If you can quantify what the cost is you could start action in the small claims court against them. Google for moneyclaimonline.

If you can prove Wonga were somehow negligent in satisfying themselves as to the applicant's identity you might have a case. For example, if the person used a different date of birth or address and Wonga still chased you for the debt.
Otherwise I think you'd be looking at making a claim against the fraudster themselves.
I think you'd need it in writing that the Wonga debt was the reason for the failed credit check though, otherwise you'd struggle to convince a court it was strictly down to that.What will your verse be?

I have no idea who was responsible for the fraud and don't think I ever will
scary! I get to 2.2% as my current mortgage rate is 4.79% and the 1 I tried to move to was 2.59%. The credit check the bank made shows up on my credit report so I can prove when i tried to move it and my credit report was perfect other than the two wonga loans so they are the only reason we were refused.
