    Yes, that's exactly what I'm saying. He doesn't have a direct line, calls to the dealership are to his "lackies", only they have his number, and when a viewing appointment is made he drive up to take care of the sale and then shoots back off again.

    None of his lackies (I think they call themselves the "Valeter" and the "Cleaner") have the authority to take a vehicle back or make a sale in the first place, and in their own words "He's a bloody nightmare, sometimes doesn't show up for days".

    Clearly the behavior of someone trying to avoid more than one dissatisfied customer.

    all you had to say to one of his "lackies" was that you were returning the car the next day and to tell him

    it doesn't look like you were really trying to reject the car if you are driving it daily...

    You should have seen the wear pattern on the fronts... Something I blame myself for not noticing sooner... It's one of the most obvious points to check... :(

    Yeah, I should have walked from Taunton to Exeter for work shouldn't I? Or maybe I should have taken three trains twice a day and left my disabled partner unable to leave the house? Yeah. That would've been the more sensible decision to make.

    Or perhaps I should have maxed out a credit card I wouldn't have been able to afford the payments on to get a car elsewhere? Yeah, that would've been an ideal alternative, too.

    Let's get some perspective and sense of reality in here folks.

    Anyway seems a waste of time continuing, I've already conceded and advised my intentions but some of you seem intent on continuing your condescending, biased, and patronising line of reason which frankly just makes you look like unhelpful b******s more intent to make someone feel like crap than actually find a productive outcome.

    didn't say he actually had to do it, but it might have got the message across to the boss what the problem was...
    it's almost as stupid a suggestion as not bothering to do a proper inspection on an old, high miler....

    obviously if you are going to use the SOGA to do something about this you should understand it first (that's the perspective and reality bit)... apologies if pointing out the obvious flaws in your argument are seen as unhelpful, but it might save you some hassle when it comes to talking it over in a court or wherever you plan to pursue it...

    Sorry, but if cash is that tight and a car that necessary, why the hell buy an 11 year old motor with SS enterprise mileage?

    This might sound silly and very few people believe me when I say this but as my OH suffers from scoliosis, sciatica, and chronic neuropathic pain, we need a spacious and comfortable car with effective climate control to prevent his condition from causing pain that results in him being unable to move or passing out - which has happened, several times.

    But like I've already said, we've decided to get a car on the Motability scheme now (VW CC GT - bloody lovely) - and will be selling this one - but it's a lovely E39 that deserves to be looked after and I will do that to ensure the next owner isn't subject to nasty surprises like I was - and only expect reasonable help from the dealer in ensuring it is roadworthy for the new owner.

    After eight weeks of point blank ignoring me he is looking at it - god only knows whether he'll actually do anything at all - he isn't answering his phone so I have no idea at present what's happening or what his intentions are.

    Thank you to the others for confirming the grey areas of SOGA.

    Pity about the attitude with which they were portrayed.

    Neither did, no. I took their findings and forwarded them to other independents to obtain quotes off my own back, so that I could be confident I wasn't being spun a yarn by them to get them on to a quick earner.

    Not entirely sure the wee chavs round here are driving round the local car parks in oil burning BMWs.

    Generally somethign tinny you can put a big exhaust on not a smoker so I'm not sure you can describe the OP's car as being a "classic" boy racer car.

    At 120k it's not enterprise miles either really. It's below average for the age and well below average for a soot chucker I'd say. The issue is servicing, if it has been looked after then it shouldn't have an issue in terms of the motor or transmission.

    The electrics and as the OP has seen, suspension parts are another matter. It's a big heavy car and they are hard on all these bits.
    What if there was no such thing as a rhetorical question?
