In terms of advising them I don't believe it is of merchantable quality - not being local I can't just drive 100 miles to Bristol on the off chance the owner might be in and sit and wait what might be until the next day for him to maybe arrive maybe not.
If I had the option to simply "Stop driving it" for eight weeks then I would have had no need for the vehicle in the first place. If I had the spare cash to buy another car whilst waiting, I would have clearly spent more in the first place.
Anyway I've already agreed with most of the points raised in my prior post - if you care to read it properly - or is my conceding not good enough either?

I'm not sure I've ever owned an 11 year old car that didn't have missing exhaust heatshields in all honesty.
These tend to rot through in the bolt areas after four or five years and most garages just rip them off and advise to not bother replacing.0 -

I had contacted the dealer several times from the day the wheel alignment was done until they finally got back to me just under a fortnight ago.
I have proof of this in the form of emails sent and phone calls made on my bills.
I have a witness who will happily sign a sworn affidavit that I was told the car was fine, yes.

We'll see what he does to the car when he gets back to me and go from there.
If the dealer hadn't ignored me for two months running and hadn't lied to me about the warranty, lied to me about the condition of the car, and all round be an uncooperative rude nasty ignorant man from the get go despite my (initially) diplomatic approach, we wouldn't be here now.
There are a few grey areas, I agree with that and have conceded that from the get go, which is why I am asking that he only look at a tiny proportion of the litany of issues the vehicle has been diagnosed with.
Given what everyone has said I've actually taken the decision to let him do whatever he sees fit to the car and get the rest sorted out at my own expense - in all honesty it's a cracking car, it drives beautifully, it's comfortable, it's in overall very good cosmetic condition (I've had the wheel arch liners done myself), and it deserves to be looked after.
I shall be selling it soon anyway as my OH has ordered us a car on the Motability scheme - I just want to ensure whoever the car gets sold to doesn't have any nasty surprises like I did and it can't be denied that there was at least some dishonesty and failings on the part of TC Cars - lying about the warranty, failing to get back to me for 6-8 weeks.
I would steer of "classic" boy racer cars unless you can gen yourself up on what to look for when buying, or at least pay for someone that does to have a look for you.
It's an 11 year old banger with all the sorts of quirks you would expect.0 -

haha, my only experience of second hand cars is buying a few in my time...
You've bought an old car with high miles - if I was doing this I would fully expect that wear and tear items would be needing addressed, if I was buying something with a warranty I'd want to see the conditions of the warranty before agreeing to it - I would also have given the car a decent inspection before buying it, and if I found there was potential serious issues with the suspension in the first couple of weeks I would have taken it back to the dealer to look at rather than driving a couple of thousand miles on a car with potential safety issues (as you didn't know what the issues were)
you already have taken legal advice on this so why are you on the internet asking for advice? If you think you have a water tight case then get on with it.
no one has said that the dealer has done everything correctly, but in my opinion, you have not done everything correctly either and it would seem that the legal documents you are interpreting aren't consistent with the other interpretations of them - are you saying that the dealer didn't answer his phone once in two months? can't sell many cars like that....This is a system account and does not represent a real person. No, i'm not saying they did everything correctly - apart from anything they didnt manage your expectations about what it mean to own a 120K miles car.

Well, that was your first option under the SOGA and a prime example of how it all looks very well on paper, but how it doesnt really work out so well in the real world.0 -
izools, as you have already started changing things on the car, take a breath and move on. The trader will simply say the car is not as sold and you really don't have sufficient evidence of otherwise. The 4-wheel alignment may also be open to contradiction. Angles are measured in degrees and minutes, (even seconds if they have an over-expensive rig). Stating that the toe or camber was out by 12mm is either nonsense from a thick fitter or they meant that they had to move the tre by 12mm. I can assure you that an e39 with a tre out by half an inch would squeal like a banshee at every bend and burn out its tyres in no time flat. By all means broadcast what a crap outfit they are, but don't make the mistake of throwing good money (time and energy) after bad.0
