Rejected by POPLA

This is a free car park with no time restrictions.

I appealled to a PCN than got rejected ... i emaild them immediatly with more photo evidence that showed there were no yellow lines where i parked and no signes near me only one about 30 ft away that was actually tied to a tree facing the wrong way. I had no response, then the letter form the collections arrived so i phoned them and they basically said i lost my appeal so pay up or get a solicitor. i immediatly emailed all itinary inc photos to POPLA and they responded next day that i couldnt appeal as i was a few weeks late so said to pay the fine immediatly. i pointed out that i got booked at a hospital and was in and out over the previous 6 weeks on a weekly basis so had other things occupying my mind that was why i was late responding to them althought i responed back to the PCN company.
What happens now do i pay its gone from £30 early payment to £114. My argument was i was never in the wong in the first place. I am more than willing to argue me case in court as i have all evidence that i didnt park illegally.

I am Seriously stressed over this. Please help me?

    Someone more knowledgeable than me will be along soon, but I believe the advice from this point is ignore them. POPLA decision is binding on the parking company, but NOT on you.

    Don't stress over this please, in Wales it's free to park in hospitals , so there can be no possible loss to them. Popla are owned by the bpa, the bpa are basically owned by parking companies, can you see that there is a major conflict of interest here ?

    This will not go to court, you will not have to pay this stupid fake parking ticket. You can ignore everything short of a small claim, which is highly unlikely to happen, and if it does you can get an extremely good defence from the guys over on pepipoo.com

    Are you considered disabled under the Equality Act 2010? The hospital could be open to a claim for discrimination for not making a reasonable adjustment, and for harassment by the parking company and their agents. Who by the way is the parking company ?

    Im not disabled. the car park was full so we parked on the back road, we even checked around us to see if it was safe to park. The double yellowas were on the other side of the road with a no parking sign - nothing at all where we parked.

    Thanks for the advise, i just wish i didnt do the honourable thing by replying to them so they had my details.

    Okay , you were going back and fore, if that was for a long term illness that could be covered under the equality act , you don't need a blue badge to be considered disabled.

    You haven't mentioned who gave you this fake ticket, it sounds as if you were in Morriston or Singleton hospital, I know there are problems in both places. Though Bridgend is a bit of a mare as I think Vinci is there scamming.

    On a point of order. POPLA isn't owned by the BPA. It's run by London Councils which is a government organisation.

    It's owned by the bpa! Do some research on this.
    The BPA established the Parking on Private Land Appeals service in October 2012 alongside the Protection of Freedoms Act. Now for the first time, motorists in England and Wales have access to a free alternative dispute resolution service.

    In your case the operator rejected your representations in April 2013 but your appeal was not received at this office until June 2013.
    The Adjudicator has therefore directed that your appeal cannot be registered.
    In order to avoid any further action by the operator, payment of any amounts owed should now be made without delay. Details of how to pay will appear on previous correspondence from the operator.

    The BPA didn't give you the fake ticket, it was one of their scamming friends. Anyway the only thing you to do is to ignore this from now on, there is a minute chance of a claim if its Parking Eye , Civil Enforcement or UKCPS, but I doubt if it is them so I wouldn't worry about it.

    As for popla saying to pay, its basically their bpa directive saying cough up mate, as I mentioned above the bpa own popla, london councils who run it are in the bpa, so the conflict of interest is plain to see.
