''Schedule 4 of the Act.'' ...I just noticed that you haven't said which Act so needs to read:

''Schedule 4 of the Protection of Freedoms Act 2012.''

and at the end I would lose ''however many pages of evidence they may send to POPLA -'' because that was written as a direct pointed remark for Parking Eye who send 50 pages of twaddle!

I'm wondering why you're doing anything to respond to this? Our daughter got a G24 letter earlier this year, thanks to the advice on here we've ignored the string of rubbish letters they've sent her. They 'passed' it on to CCS Collect, meant to be debt collectors, but it's them with different headed paper. They constantly say one thing in a letter and change it in the next. £95 in a previous letter has dropped to £47.50 in their latest desperate attempt to re-coup the money they've wasted on obtaining details from the DVLA.

None of these dodgy companies will ever take a PCN to court, if they lost and they surely would, they'd set a precedent and their scamming industry would crumble. Furthermore, Debt Collectors have absolutely no power to enter your premises, they are not bailiffs!

Sure these letters look threatening, they are MEANT to be, it's how they scam, but please don't waste any time on them and certainly don't waste any effort in writing to appeal it. .....oh and do NOT stress or worry about it

Because the advice has changed, because some PPCs now do try small claims and because we've learnt how to win at POPLA at the scammers' expense!

Yes some of them do (some always have done) and lots of small claim Court cases have been lost by the PPCs. A small claim decision never sets a precedent.

Super result OP. Yes, agree with Hovite, please post the text of your POPLA decision in the POPLA sticky, which will give the regulars the satisfaction of seeing their specific advice coming to a successful conclusion and also as an encouragement to newbies that these PPCs can be defeated with the right form of words.

    :T
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
