Tenant wanting to ensure deposit is refunded

Hi,

I am currently looking at moving out of my current rental flat into a different area but want to ensure that I receive my full deposit back. Other than this one area I have no doubt that I will receive it.

About 3 months ago there was a water leak in the flat above me. This has now been fixed but has left large watermarks in 2 of the rooms. Due to the age of the decor to correct this would require the whole room redecorating.

I know this should not affect my deposit but just really wanted some clarification.

    I think it's up to the flat above you to sort out with their insurance ... I had the same situation a couple of months back

    Not down to you. Have you notified the LL / Letting Agent about the problem? Thy may be able to claim off the owners of the flat above for any damage caused by the leak to their property.

    Yes, when it happened I informed my letting agent who arranged for the letting agent of the above flat to fix the problem. This was done over the telephone and not in writing though. But hoping that the fact that the water marks are on the ceiling shows that there was nothing I could have done other than report it.

    As long as the LL has been kept informed and knows any damage was due to the flat above and not you then there shouldn't be any problems with your deposit. Any insurance payout from the flat above should really have covered redecorating costs for the watermarks, so if the LA hasn't arranged for this to be done while you were living there then IMHO they can't charge you for it when you leave. If they try to just dispute it with whatever protection scheme your deposit is with.
