Pulling out of renewed rental before start date

I was hoping someone could provide some assistance...

We have been renting in Manchester for 2 years now, landlord served s21 notice and gave us the opportunity to sign a new 6 or 12 month contract, he didn't want us to be on a rolling contract. We signed for 6 months to see if certain problems (food smells) would be resolved by a nearby bar.

It keeps happening and we want out. Our current agreement expires 16th of this month, with the new one starting the 17th.

If we notify them of our intention to leave before the 17th, would we able to get our deposit back (it's correctly protected) or would be forfeit it?

    Little bit confused here, forgive me :)

    You have a current agreement that finishes on the 16th June?

    The new one starts on the 17th?

    If you have signed a new agreement to start on the 17th June then you would be liable for rent until the end of that tenancy agreement.

    If you haven't signed the new agreement then you can leave at the end of this agreement - ie the 16 June.

    You do not have to give any notice to leave at the end of a fixed term agreement but it is polite to do so because the LL will need to advertise/get new tenants.

    Have I got that right?

    You have signed a new legally binding contract for 6months.

    Nevernmind your deposit, you could be sued for 6months rent!

    Why on earth

    a) did you not simply move to a Periodic(rolling) contract?7
    b) Did you renew given the unresolved smell issues
    c) Did you renew given you don't want to stay

    Your only option is to negotiate and hope the landlord releases you.

    Be prepared to pay for this.

    We've not given notice or anything yet, I was just investigating the potential implications. Thanks for your replies on this.

    If you wish to negotiate an Early Surrender of the new tenancy (1th this month), the sooner you start the better, as this gives the LL time to start advertising, thus he is more likely to agree.
