I do judge stupidity on the roads. I'm sure your ex-copper husband does too!!

OMG I have a stalker!!! Seen as you have only been a member for 9 months you must have gone to read my previous posts, or else you are an AE!

Everyone has momentary lapse of concentration in any activity and this includes driving. We are humans not machines.

OP one query if there was snow on the road how could the police's photo's show you over the line as the line is white and would surely have been obliterated by the snow?

I'm not a stalker. My username tells people very clearly that I'm NOT A NEW USER. I was a member many years ago but forgot my password and locked myself out. So I had to start again. I just have a good memory for posters' names etc.

As for your point about being human,

Police person: "I'm sorry, but due to a momentary lapse of concentration your son/daughter won't be coming home today, or any other day".
Poppy9: "that's okay officer, we all have momentary lapses in concentration. We're only human after all."

    Pull the other one!!!

In this case no one was hurt.

Through luck rather than judgement. ;)

(I spent today with a family who lost a son to a momentary lapse in concentration in a car. He was 21, and 10 years on its still hard for the family to deal with. Nobody should ever have to go through that.)

Er, from the OP and basic physics. S/he says they braked, that they crossed the line and were doing 13mph. It's possible that they braked and skidded and sped up over the line, but as they came to a stop shortly over the line it's not likely. They may not have been travelling at the 40mph limit for the road, but being unable to anticipate the changing lights and stop in time indicated all was not hunkydory.

The OP doesn't feel justice was done. Why not? Had they done it in the middle of a perfectly dry sunny day would it make a difference?

And that drivel is helping the OP in what way ? Perhaps you don't understand the ethos of this site, and the fact that we are here to help not make a judgement what should have happened. It's completely irrelevant lecturing people on your ethics, as I said this is about the OP not you!

It's not ethics. There are inconsistencies in the OP's story. 1 second at 13mph is 19 feet. No normal car is 19 feet long, so something there doesn't add up.

But anyway, they're obviously not very good at driving in snow/ice. Perhaps my posts will make them want to improve. They went to court so that a judge could decide. The judge decided but they aren't happy with the outcome, even though it was probably absolutely the right judgement.

What else could be said? "There there OP. That solid white line was obviously in the wrong place/not meant to apply to you/only a summertime road marking....."?????

  • 13mph as you crossed the white line suggests either pretty late braking (therefore not paying sufficient attention to the road) or braking too harshly for the conditions and going into a skid (therefore not driving appropriately). Even if traffic lights are green you should still ease off as you approach as there is always a chance they will change, and this is even more the case in the conditions you've described. Also, it doesn't matter that you were still some way off the junction controlled by the lights - by going over the line you were placing both yourself and others in potential danger and braking traffic rules. What if you had placed yourself in the path of a truck which needed a wide swing to turn?

I know this sounds harsh but driving in dark, icy conditions is very dangerous and to be honest it doesn't sound like you fully took this into account. I'm with notanewuser on this, momentary lapses in concentration while in control of a tonne of fast moving metal, especially in adverse conditions, are not ok. If I had £1 for every car/van/lorry driver whose "momentary lapses" have resulted in my having to take evasive action to avoid being taken out on my bike I wouldn't need to be on a money saving forum! What if those lights the OP went through had been for a pedestrian crossing and not a junction?
I don't like chick flicks, I get grazed knuckles doing my own car repairs and I ride a massive cruiser motorbike. To many this makes me a bloke in disguise but to my husband this makes me perfect

What difference does it make ? This is about what can be done about the fine and points, the answer is not a lot but accept them and pay up. All the morality side of things is not relevant , the it does not add up is not relevant, the should have have braked sooner is not relevant.

So the morality police are here !

OP I advise going to https://www.pepipoo.com with this and ask there, you will get constructive advice on your situation without the judgement of people in this thread. But I think it's going to be to pay up to be honest
