Asda refuses refund on video games

It was sealed and yet they refused refund due to new policy aboutcopyright. Are they allow to do it? I paid by CC.

    You have no right to return just because you felt like it.

    I'm not sure what they mean by exchange of title.

    The only 'right' you have to return any item (unless it is faulty) is whatever right is granted under the store's returns policy. Software is one of the most common exclusions, because it can easily be installed and then resealed.
    Exchange of title means what it says-they will exchange it for another item, but not refund.
    No free lunch, and no free laptop ;)

    As per what Pound has posted their policy allows returns if in original packaging. SO if it is sealed and unopened the OP has the right to return and refund. It could just be the case of an individual store person deciding they know the rules or decide the rules!!.....

    I would say call CS and also put an email complaint in writing to Asda. They will not only refund the games but also add compensation on top if the above return policy is correct.

    There is NO "right of return", Asda might have a store policy in addition to statutory rights, but it is not a right.

    Asda can also decide whether to allow or deny that policy.

    OP is better advised to go back and ask a manager nicely, or complain to Asda head office, but any talk of "rights" is just going to get their back up.

    Surely one time only exchange of title means if you've changed your mind, you are only entitled to a replacement different game and can't then return that one. Its in addition to your statutory rights if the item is faulty or damaged.
    Please forgive me if my comments seem abrupt or my questions have obvious answers, I have a mental health condition which affects my ability to see things as others might.

    Their t&cs allow for one swap for another title but not a refund. The policy should be displayed at the cs or video desk.

    The OP has a contract with Asda that includes the return policy. Asda can't then decide not to honour the terms of that contract. So in that sence the OP has a contractual right to return the item for a refund.

    The only other time I've seen the term 'exchange of title' is when buying or selling a house. So surely it means ownership of the game changes from the customer to Asda, in exchange for some money.

    Pound I disagree with both points.
    No right of return means you are stuck with it even if you do not like it unless it is faulty.
    If it is faulty they will replace it with another copy of the same game to prevent you building up a library of games when you have only paid for one.

    Seems fair to me- if you don't like the terms there don't buy it.

    Asda in store T&Cs specifically offer a 28 day once only change of mind exchange for music, video and games as quoted in post 5. OP has no right to a refund though.
