Deposit return

Hi everyone,

I have problem with my previous agency. I moved out on 16/05/13 from my previous flat. They written to me that they have got time to 31/05/13 to inform me about any deductions from deposit. I received email 4 days later (so on 04/06/13) about deductions. I replied to them that I do not agree with those deductions and they have got time to 31/05/13 to inform me about them. They have written that they left voicemail on my phone on 31/05/13, but this is not a true as there wasn't any voicemail on that date. Also they have written in first email something like this "Should you have any queries please email them across to me as all correspondence in relation to this matter needs to be in writing.". So, they should inform me on 31/05/13 by email, not by leaving voicemail.

Can anyone tell me what I should do with it? I am still arguing with them that I will not pay for it because they informed me to late about any deductions. Should I write to them that I will go to court if they will not give me back whole deposit or what?

    Apply to the deposit protection scheme yourself, then the agents will have to justify any deductions that they want to make.

    What are they claiming for?

    Was deposit protected in a scheme?

    Was there a full inventory at the start of the tenancy?
  • They want to deduct £40 for removing bed which is outside of flat but on property area. The bed is not mine and someone has left it there.

    The deposit is protected by DPS (depositprotection.com).

    They cannot charge you for areas to which you do not have sole access.

    And they cant take 14 days to check the property, it should e done within a reasonable time, ie 48 hours, and ideally on the day you return the keys.

    I know you didn't dump the bed, but can't you just move it yourself to save all the hassle? Or is that out of the question?
  • Guest101 - I asked them to check property with them, but they told me that I have got to pay £60 for it what is ridiculus. I got also to pay £30 for reference...

    Gordon Hose - I was thinking about it and I will do it if anything else will not help. It is because I moved from Nottingham to Birmingham. So I will need to pay £15 to get to Nottingham.

    The agency about which I am talking is Martin & Co.

    In terms of check in/out fees normally the landlord pays one set and the tenants the other (where I am anyway). I assume this was detailed in your original tenancy agreement as well?
    If you deposit is protected then I would request your deposit back through the agency holding your deposit. You don't want to find you are out of time. I believe they should be able to release the non-contested deposit back to you.
