    Over the long term i.e. years the OP would be inconsiderate if the tree annoyed the neighbour due to it's size and location, and the neighbour pointed that out. Due to the time scale of 3 months the OP cannot be considered inconsiderate as they haven't owned the garden long enough.

    It would have been more appropriate for the neighbour to point out that they asked the previous owners many times to cut down the tree and nothing happened.

    But now the neighbour has taken drastic but legal action (but at the wrong time of year) it's best not to fall out over it.

    BTW Just a warning to people if you are going to post things on line with photos or a very detailed description don't be surprised if the people you are complaining about find it at some point during the next two years.
    I'm not cynical I'm realistic :p

    Did you get a full structural survey before buying? I think I would have been very concerned at the proximity to the house.

    From memory, moving into a 'new' house, there's a stack of things to attend to in spare time. Getting to grips with a garden, which has perhaps had 10 years unchecked growth, especially in one of the wettest periods in our recent history, might not be top of many people's agendas.

    i dont think we had fully unpacked after 3 months, let alone started on the garden

    We still haven't - and we've been here just over two years :o Have started on the garden though ;)

    Sorry for bringing this back up again but that is the funniest tree I ever saw!

    The house Im buying has a neighbours tree that overhangs and blocks out the sun in the garden so I was searching for similar cases and found this! lol

    Although I dont plan on butchering the thing Im certainly gonna go out there in the black of night wearing a balaclava and give it a good old sawing :)

    Concentrated Glyphosate will do the same if drilled into the base of a tree. see instructions for Rosate 36.
    Basically you drill a hole(s) near the base of the tree, pour in the specified amount of product, then plug with a wine cork or similar. It does work

    That tree looks like it blocks more light out of your garden rather than your neighbours, going by the shadows? Do you have a west facing garden?
