    Your mistake was not in failing to use a CMC but in letting the period for referral to FOS pass and then taking the court route.

    Unfortunately my husband was made redundant, so we had more inportant things to concentrate our attentions on. Once he'd found a job, we returned our attentions to the PPI, only to find it was out of time.

    I'd made a PPI claim for about £800, & taken it via the small claims court (as I'd let the 6 month limit from the ombudsman unknowingly pass). I understood that the only cost I would bear would be the cost of me taking this to the small claims court i.e. the £60 - but they lodged a counter claim - I then, didnt want a summary judgement, & couldn't afford risking losing this, and having to pay them costs etc. I would have been saddled with this potentially costing me over £200 if I lost.

    It is a risk taking it to court as the PPI issue is largely an FSA (now FCA) thing and not a legal issue. With legal action, you have to show breach of law and provide evidence. Almost certainly you couldnt do that. So, the firm would be quite happy to go to court. Plus, there have been some cases in court already which found in favour of the firm and provide some precedence.
    I took online legal advice on this matter which cost me £30. It would appear to have been poor advice.

    Very much so yes. Any advice for you to use a method that costs money and could incur greater costs instead of using a free of charge complaints process which is more consumer friendly than the courts would be bad advice.

    Maybe he should have claimed on the PPI policy as that is what it is for.

    That was one of my main gripes - I worked for Local govt (stable job) & it had been sold in my name only!! so it was no use when we needed it!

    It's not. Lots of redundancies taking place. Can be a good reason with some loan and credit card PPI. Not good enough for mortgage PPI though.
    & it had been sold in my name only!

    Most PPI is single. That is how it is. You take one to cover the person, not a couple (although some do allow a split)
