have debt collection letter

i took note from forums, friends to ignore the parking charge notice which i have done since mid January but now I have a debt collection letter and the sum has gone from £60 to £160.

On further reading it has become apparent to me that I may get court papers, as ignoring is not the best option now and i don't want to go there.
Should I pay the £160. Thought about writing to them and offering a payment to them of what is more realistic concidering the following statement i found but have I left it too long...."Charges for breaking a parking contract must be reasonable and a genuine pre- estimate of loss. This means charges must compensate the landholder only for the loss they are likely to suffer because the parking contract has been broken. For example, to cover the unpaid charges and the administrative costs associated with issuing the ticket to recover the charges. Charges may not be set at higher levels than necessary to recover business losses and the intention should not be to penalise the driver".

They do state appeals should be with in 7 days

    If the original PCN said appeals had to be within 7 days then they are not compliant with the Protection of Freedoms Act 2012 nor with their own industry's BPA Code of Practice. Do you not realise that breaches like that make this 'charge' unenforceable?

    Don't write to 'whoever it is' (I can guess who) nor their debt collector and don't offer any money. If you've ignored then you STAY IN IGNORE MODE.

    And don't reply to any pm offering to help or asking for more details and pretending to be friendly - the firm I think this is, do come on this website.

    Carry on ignoring and don't be scammed. You are not a victim and the vast majority of these fake PCNs will never ever go near Court. Relax, nothing has changed.

    You can't be serious, why are even thinking about funding this scam? Doesn't thousands of posts and threads on here tell you that this is a scam! Debt collectors are scummy vermin without any powers to enforce anything! All they do is write preprinted templated letters, all they do is add your name and address to them, they send out thousands of these letters.

    Now which scamming parking company gave you this fake ticket? And is it in England or Wales ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Sorry 28 day for appeal.
    Well in reading the forums I'm getting the jist that they are now willing to take people to court. Friends are still saying don't pay and that i wil lget more letters and the price will go up.... it's worring me now. Previous years posts say don't pay. Old 'watch dog' says throw it away but then there are posts saying that it has all changed now and that they will go to court. Even a post saying what do do if you receive court papers ohhh..

    Can someone say that they themselves have ignored and not ben taken to court

    Look its very difficult to advise you as we need some answered

    1) who is the original parking company ?
    2) who is writing to you now ?
    3) is this in England or Wales ?

    We can then tailer the advice, but when it's at a debt collector stage there is only two options, either pay or don't its that simple

    Dont dispare, your begging letter will come in handy for emergency loo paper, or for picking meat out of your teeth, or if you have a pet roedent, shredded the begging letter will make a nice warm bed for it :money:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Thought of sending the £60 stating that it will pay for any loses and don't contact again. Thoughts

    Don't want to go to court over this, had enough, just come out of horrid divorce.

    Dont pay the scummers anything there calling your bluff and hopeing your a soft touch to fill there grubby bank account up however if you decide to pay them, will you send me the same amount i could do with a bit of extra cash ..... do you get my drift :money:

    this is a comment from a barrister who deas with uk traffic law; thought good to add for others to see.

    'They will send you some very nasty letters though. You will get debt collection letters making threats of legal action. They will probably get Graham Whyte solicitors to write to you as well. None of these are anything to worry about. It will not impact upon your credit history and it will not add to the costs.

    If they do sue then they would only have a claim for the sum of the original fine plus about £35 in costs. They will send you debt collection letters in which they will threaten to sue you for their debt collection costs. Do not be intimidated by that. They have no claim for that.

    Unless you actually get a court summons, none of these correspondences have any legal basis. If you do get a court summons then you can always part admit the claim and offer £5 for their loss'

    hi there i also received a letter of litigation from a company called debt recovery plus ltd. i received a fine from a company called total parking solutions for parking in a disabled bay without a badge displayed. i followed friends and family advice of ignoring it and have done it up till now. this letter of litigation states if i don't pay the charge of £149 from a charge of £30 they will take me to court.

    i just wanted to know where i stand in this situation. the 1 other thing that has meant non-payment up till now is the company giving the wrong dates as i received the fine on 07/03/2013 and in there letters they state 07/02/2013.

    all help and information will be appreciated,
