Who will write all the letters he instructs them to as long as he pays their bill.

If you'd like to run his bill up to the stratosphere just respond to them personally giving as little information back as possible, or referring them to letters already send to the previous firm. Which they will not have access to. Back and forth. Back and forth. Ad infinitum.

Thats what I am going to do. In fact I never received the first letter ;) just like he never received many from my solicitor. His solicitor never met the deadlines either nd always needed 'more time'. Karma eh :)

My friend is going through something similar although it hasn't reached the tribunal stage yet (my friend has just objected to the application and is waiting to hear the otherside's response). I am just concerned that although your ex was found to be lying about your inheritance, that the judge still believed he was telling the truth about the loan? Doesn't it matter that he lied and that he wouldn't get the letter forensically tested?

Suzie, it was a nightmare, it took 3 years in total. My solicitor did it by the book, his was late in everything and got away with it! There were so many lies which I could prove. If I was your friend I would just take it straight to court, quicker and more final.

Thanks, so didn't the LR care that you could prove his lies? Surely it is serious if he has lied on his Statement of Truth? Did the LR take 3 years to decide?

Thanks and also did it take 3 years because his solicitor kept stalling or was it because the LR was busy?

Sadly there is no rush with he LR. But mainly it was due to his sol stalling for time and conveniently sending the wrong paperwork etc. He even tried to use a without prejudice letter!

Thanks again, but could you prove that he had lied on his Statement of Truth (as my friend can) and did that not matter to the LR? I can't see the otherside stalling in my friend's case as they are as keen to see it sorted as quickly as possible.

My solicitor said it was up to him to prove the lies not me. She was confident we would win, his case was very weak and based on lies. The reason they stalled was because they knew the case was weak and they hoped I would get fed up, but I knew I was in the right. I think the adjudicator knew this but had to state that he could chase for money as an unsecured debt, as anyone can, but again you need proof. This all happened over 5 years ago and suddenly he has reared his ugly head as the house is now on the market. If his sol at the time thought he had any chance of success as an unsecured debt he would of taken it to court 5 years ago. Its good news for your friend if they both want it sorting. My ex did it out of spite. Which in the end cost both of us a few thousand pounds.

Thanks very much again, but what do you mean by that? He wouldn't be proving his own lies?

Your ex sounds like a very nasty piece of work. If he hasn't got proof then there is nothing he can do to make you pay the debt. My friend has been replying to all the solicitors and LR letters himself so it hasn't cost him anything at the moment.
