parking invoice - out of blue

Received parking invoice 30 days after parking on private land at a large shopping complex offering no discount!
Next day received letter thanking me for my recent correspondence which i have had no correspondence with them saying they cannot investigate the appeal as only the parking ticket was received with no appeal.
Some time ago I had parked in a large complex but no ticket was on car on my return, parked for 15 mins as shopping complex was closing and parking is free avoided parking in pedestrian exit yellow criss crossed area.
children playing in car park on arrival, car next to me went over the lines so to avoid blocking exit (yellow criss cross area ) went over my space.
is this fair can i appeal

    You don't say who gave you this, and whether its in England or Wales? Can you supply that info ? - thanks
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Who are UKCC? Do you mean UKPC?

    And was the first letter claiming that they'd put a fake PCN on your car or was the letter claiming to be the 'PCN' itself with photos of your car?

    Hello and thanks in advance for helping,
    Oops it was UKPC
    First letter has a photo of car parked over line - notice to keeper to pay full charge
    Second letter written a day apart, thanking me for correspondence in relation to PCN where they only received the ticket and no appeal, this letter then asks for a full detailed appeal!
    until such time for35days from the date of the letter they say the Parking charge will be on hold or if I should wished to be ripped off I can pay a reduced rate within the 35 days of £40
    Please advise :eek:

    If it's a Notice to Keeper (NtK), with no previous Notice to Driver they've got just 14 days from the date of the 'offence' to get that to you. 30 days makes it timed-out.

    However, before giving that as the definitive answer, could you scan your NtK (front and back) with all personally identifiable detail obliterated (name, address, car reg number, NtK number, any barcode, location) - but do leave the date(s) showing. Once we've seen that we can give you the next steps to take.

    Until then, no (more) communication with the PPC, and do not give any indication of who the driver was.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Sounds like they sent the second letter in error (maybe your surname is the same as someone else in their scummy databank of potential victims).

    Why we have to type the same advice out on every thread is beyond me so I will link the last time I typed it today (less than an hour ago) instead:

    HTH and then when you get a rejection letter it will be POPLA stage (read the threads on the forum about POPLA and do not word that stage of appeal without more advice). No need for the scared face shocked 'smiley' seeing as this is only well known UKPC as featured on loads of threads laughing at them.

  • Overall park at large shopping complex don't usually go there, ( choice of blocking exit or parking over line in a free car park, parked over line
    received notice to keeper of a PCN, having not been personally issued with a ticket
    the next day i receive a letter from UKPC, thanking me for correspondence i did not make, saying they only received the parking ticket and no written appeal giving me thirty-five days to appeal
    i wrote back informing UKPC i had no contract implied or otherwise with UKPC and returned their invoice -NO CONTRACT RETURN TO SENDER
    4days later saying charge correctly issued a POPLA form not sure if POPLA number/code needed or just paperwork
    also talks of pay fine x

    Just worked out UKPC, sent first letter 30days after they say I received the ticket, the first i new of this ticket was when the notice of keeper letter arrived..... does this also have a bearing on the ticket...... Or is it working days

    If the first letter was the actual Parking Charge Notice with a photo of the car driving in and out, then 30 days is too long for them to take to issue it.

    But as you've said there was no discount, do I take it that the first letter was actually sent to the keeper because the alleged 'PCN' remained unpaid by the driver?

    Have a read around the forum for strong POPLA appeal wording as posted lots of times, search the forum. Also read the POPLA decisions thread and here's a couple of links to start your reading, showing POPLA appeals:

  • I was unaware of the PCN until the first letter came 30days later to the notice to keeper
    The very next day i then received a letter saying thank you for your correspondence but you have not submitted a written appeal, i had sent no correspondence
    Following on from this i wrote a letter to PPC expressing i had not entered into ant contract with PPC inferred or otherwise and owe them nil par- they rejected this saying their signage was adequate sending a
    POPLA appeals form
    this is where I'm at now
