Once again, another duff judge by all accounts. This is truly awful and lamentable tht you hve no real cumback on the judge's personal opinion. By your account that's all it is here, very little if any consideration for fcts f the case or precedents of case law. Appalling, truly appalling.

I second that. It's a decision that simply does not correctly apply the law, as far as I can see.

Shocked by this one. You have been really unlucky in being allocated this judge. Prime candidate for an appeal, I understand though that he cost and potential risk becomes high.

On the first anniversary of the Upholding of the Sturgeon Judgement, exceptional/extraordinary progress has been made, my hope for the next year is that a case/appeal goes to a higher court and some precedent is set.

Duff District Judges in the court system is truly appalling.

    Hi all

Thanks for the commiserations. I don't think we'll be going any further with this. It was quite a jump to go to the Smalls Claims Court in the first place as we'd never done anything like it before.

We haven't received a written judgement, but when (if?) we do I would be happy to post it here if it helps anyone.

In light of the Jet 2 ruling appeal recently announced, I'd say that both Kevtamuk and Friend of Bill have brilliant chances at appeal.

Maybe so. But I'm afraid I still won't be going to the trouble. Sorry.

And you may well be out of time as there are only 21 days from judgement to lodge an appeal.

Just out of spite F-bill2, If it were me I'd send a copy of the jet2 appeal ruling to the judge, (your judge I mean) and say that you're sorry that you wasn't able, as a LIP, to convey the complexities of the legal argument across so that he/she could understand it. :p :cool2:

... For Monarch Airlines, anyway :D

Will post up full details later - but long and short of it is that their defence was struck out. And I win, with 8% interest.

(Come on now - you didn't really think Prof the Lord Vauban would be posting here, did you? ;))
