Buyer says item not accurately described, is threatening me :(

    As well as getting the feedback removed this will also get you an official warning on your account, I'm not sure the hassle is worth a formal warning.

    As for the original problem. On this board we always advise people to pretend they have trading standards support if they otherwise have no hope, maybe she reads this board or has got the same advice as well! Tell her that you do not offer a refund policy and that the skirts were accurately described and just accept the neg and move on.

    It will cost her money to raise any formal complaint.

    However, one last thought (and I've forgotton if this was mentioned) If she paid by paypal she could try a chargeback, but if she paid by cheque you will be OK as she has no other protection.

    I agree with Stavros and have had this problem myself. If you are certain you have supplied her with what you said, why should she get a refund ? you have done everything right. People will try and pick and find all sorts of excuses to try and get a refund - just because they have changed their mind. The trading standards thing is tosh !
    The way I viewed it is I can get a neg if i refund i can get a neg if i dont. Ifshe has paid by paypal then she might be able to claim a refund - but she needs to know about this plus if you can proof posting you could be ok.( Please see other threads about the paypal chargeback if she has paid this way ).
    Personally I would rather not have someone scam me, stand by my rights and not refund the money. Why should i get a neg, and lose my money ? She negs you- you do the same.
    I totally agree in refunding if you have provided the wrong goods - and i will refund the postage too but not refunding due to blackmail.
    ( out of intereast look through her bidding history to see if she has bought a skirt similar and at the feedback she has left to see if she has a habit of doing this )
  • I wouldn't refund. Sounds like she doesn't like the skirt and is now trying it on. Ebay's an auction site. You say you correctly described the items, in which case you've nothing to worry about. She's going to give you negative feedback anyway, so why bother refunding her? The contents of her email indicates that she's trying it on - like she's been to trading standards over a skirt she bought on ebay!

  • You have obviously managed to snare one of those people who think they can bully you into submission. As most people have stated, you will more than likely get negative feedback.

    From her email, you had a photo of the items in question on the auction. We all know that photos look different on different computers, so she has no excuse there. As for the colour description, beige and cream are similar. It's not as if you said it was green and then sent a red one. Finally, she stated that she had no use for the second skirt. So why did she buy it?

    Stick to your rights. You are not obliged to offer a refund. The goods were bought on the grounds of a picture and a description. The buyer thought they were onto a bargain, but didn't like them. That is NOT your fault. That is HER fault for buying them. If she had any uncertainty prior to purchasing, she should have asked.

    I don't know about skirts & such, but to have a neg. feedback removed, buyer and seller have to "mutually agree".

    No they dont. Simply submit a Square Trade mediation request, word it so she will have no interest in responding. After 10 days your feedback gets removed as she failed to reply to a mediation request. I do it all the time - almost always works.

    Costs $10 a go though.

    I would reply and say "No it's not like the item in the photos it IS the item in the photos, and there is definately no mistake been made. Therefore as I sent you the correct items, and in my opinion the desciption was acurate im sorry but there are no grounds for me to refund you."
