Buyer says item not accurately described, is threatening me :(

I feel so upset!!!

I sold two skirts to a lady. She took three weeks to pay and then on receipt of the skirts claimed that the 'cream' skirt I had sold her was actually 'beige' and as it was an inch shorter that it should have been, was the wrong item. I had specified both waist/length as all skirts vary! Further, the second skirt didnt have enough sequins and was not 'natural' in colour as I had described but 'beige'!

Here is her second message to me:

I wasn`t purely asking for a refund because i just didn`t like the skirts.
>It`s because they are nothing like the picture especially the Cream one which
>is the same colour as the other skirt you sent me and you descirded that as a
>natural colour which would be BEIGE! I`ve had that confirmed by a few people
>including the lady at trading standards. Personally i think you have sent me
>out the wrong colour of skirt. Also you state the length as 12L and 38" in
>length that is very misleading as true Marks & Spencers 12L are longer in
>length than your skirt. So it must be a factory fault with wrong sizing! The
>other skirt is ok still, but you can have your other skirt back as i have no use
>for it. I fully understand my rights & obligations as a bidder but i still
>have consumer rights as per normal. As for feedback I like to be fair & honest
>because it`s important others know the truth. Especially when you buy over
>the net.

Is she saying she only wants to return one skirt?

What are my rights as I didnt state that I wouldnt accept returns just because buyer doesnt like the colour etc. I've got 100% feedback and am worried she'll ruin it for me!

  • Okay, just one qurstion quickly, were you selling M&S skirts as that is what she has compared on too.

But from the sounds of that email she is trying intimidate you into giving her a refund. In my opinion natural and beige are the same colour, but I know that in clothing I've seen losts of different names for the same colour. But unless you are a trader you don't have to offer refunds as you are a private seller.

I see realistically that you have two options.

1 - Tell her that you will refund her, minus postage, and that she has to return at her own cost as it's not your fault. But you will probably get a neg for doing this.

2 - Stand your ground and tell her that the item was accurately described and that as a private seller you do not have to provide a refund. And again you'll probably get a neg.

So either way you'll probably get negged, but you can always respond to this with a link to get it removed
    Titch :)
  • Thanks for that :) You have echoed exactly what another friend had just told me...

I have offered her a refund minus postage because as much as I like my 100% feedback she is WRONG and I am right! I even found two other listings of the same skirt also described as cream!

I have had a negative removed before but the bidder who left the negative had to agree to its removal. Is there a way of removing it if the bidder refuses?

    this is so not fair!

you can have feedback removed easilly by putting her phone number in your negative feedback to her!

ebay will pull it promptly ;-)

supposedly you can add a link and get someone to report it, don't know if this even works.

have you left feedback for her yet? if not, make sure you give her a negative, a nice fat capitalised one. what a horror.

could we poss have item numbers to have a little look?

I don't know about skirts & such, but to have a neg. feedback removed, buyer and seller have to "mutually agree".

This sounds interesting...you leave someone a neg. containing a "www." to an unsavory site....but wouldn't this just get your feedback pulled and not the other persons? Might have to conduct some further reasearch...

no idea, keep seeing this suggested by people as a way to get feedback removed, no one seems to actually know if this, or getting someone to report you for big swearwords, works though...

you are going to get a negative no matter what here i think.

the woman states in here message that the woman from Trading Standards agrees with her. In my experience of selling a lot of cars and other items on Ebay, anybody who states this in their emails is full of rubbish, does not like your product and is trying to scare you into giving them back their money and hoping to not lose out on thepostage either.

if this was me i would mail her back and tell her she is talking rubbish, but you are willing to accept it back, minus postage etc. Then when you receive the item back take as long as possible to refund her. You are going to get a negative anyway so make sure you get it for a good reason

Alright so every one is saying you are going to get a negative, well for suitable revenge you have her phone number and email address, goto some dubious websites and start signing her up to getting.................yes i would like to receive daily pictures of naked men/women etc if she has left you a mobile phone number and not a house one also sign that upto premium ring sites.

Alright your 100% is ruined but what great revenge and a nice warm feeling you get when you know someone is getting bombarded with junk and saucy emails every hour etc!!!

Can you give us the listings numbers so we can all block this woman from bidding on our stuff!
    good luck

I'd also like to know whether the skirt is from M&S.

I agree with burbs that the bit about trading standards sounds like complete rubbish. I wouldn't go as far as s30jok though.

One thing that I did notice is "they are nothing like the picture". I presume that you have sent her the same skirts as in the picture that was on the listing, in which case ... huh?! How can they be nothing like the picture!

The only way you could come out of this with a positive is to give her a full refund and pay for the return postage, which I don't think you want to (or should) do. So if we assume that you'll get a negative anyway, I wouldn't bother offering her anything as you'll just have to resell the skirt. I'd just email her back stating that you have sent her the same skirt that you have described and pictured in the listing she has bid on and there's nothing more you can do
